CASE STUDY 2 Module 4 Case Study The purpose of this case study is to determine the ethical considerations, if any that a union owes its members. We will discuss contract verbiage and the responsibility of the union concerning Peterson vs Kennedy which initially took place in the late 1970s. We will also discuss what more the union could have done on behalf of Peterson. Ethics in Unions There are many unions in the United States, for many different types of employment, but one thing holds, and that’s the laws regarding unions and their members. According to the National Labor Relations Board, as a member of a union, “y ou have a right to be represented by your union fairly, in good faith, and without discrimination.” (Nlrb.gov, n.d.). This means that no matter your standing within the union, you’ll always have the right to fair representation in manners such as collective bargaining, handling grievances, and operating exclusive hiring halls. For example, a union which represents you cannot refuse to process a grievance because you have criticized union officials or because you are not a member of the union.” (Nlrb.gov, n.d.). Union Actions The union failed to provide proper representation. They hired a fresh out of school attorney to represent Peterson. This attorney was ill equipped to handle a case of this magnitude. Upon Kennedy asking that the type of case be changed to a non injury grievance which undermined the initial claim set forth by Peterson. Peterson was injured while working for the NFL and filed his grievance in the appropriate amount of time. His case should have been heard as an injury grievance. (SNHU, 2024).
