The compliance requirement team led the meeting with the senior management team to
determine the company compliance requirement.
The following questions were raised by the team to the senior management:

What are the services offered by SSBT?
Senior Management:
SSBT provides variety of courses in business, namely Certificate III in
Business, Diploma of Business, Advances Diploma of Business, Certificate IV in Project
Management, Diploman of Project Management, Diploma and Advanced Diploma in
Leadership and Management, to domestic and international students.
Team:
What are the relevant compliance requirements of the company?
Senior Management:
Firstly, the company is a registered training organization hence it shall
follow the Standards for RTOs 2015. Accordingly, the company is required to comply with
National Vocational Education and Training Regulator Act 2011 or equivalent and VET
Quality Framework as stated in the said standard.

To ensure safety of each and every employee and student in the company, we shall also
comply with the Work Health and Safety requirements.
Additionally as we foster a diverse environment, we must strictly comply with all of the
anti-discrimination acts such as Age Discrimination Act 2004, Australian Human Rights
Commission Act 1986, Disability Discrimination Act 1992, Racial Discrimination Act
1975, and Sex Discrimination Act 1984.
To protect the privacy and personal information of individuals such as our employees,
students, consultants, we also need to comply with the Privacy Act 1988.
Lastly, several legal compliance for our employees that we shall follow are Awards
and Taxation, Insurance, Human Rights, and Internal policies, procedures, standards or
codes of the company.

Senior Management:
The stakeholders for this project are us the senior management
including the CEO, Sales and Marketing Manager, Human Resources Manager, Operations
Manager, Finance Manager, Academic Manager, together with the Office Assistant,
Receptionist, Student Services Officer, ten (10) trainers and assessors.
Activity 2: Operations Compliance Report
Sydney School of Business and Technology is a registered educational provider established
in 2016 and located at New South Wales, Australia. Below are the functions, products, and
services of the company that are subject to compliance requirements.
Functions of the company:

Providing education to domestic and international students in compliance with
Standards for RTO 2015
•
Hiring Trainers and Assessors as well as other staff namely administrative staff,
finance staff, operations staff, security staff, IT staff taking into consideration
conformance with Anti-Discrimination, Equal Opportunity, Human Rights

Financial reporting to ATO in compliance with Taxation

Business Insurance requirements in accordance with Insurance legislations
•

Activity 5:
Standards for Registered Training Organizations (RTOs) 2015
On 2014, Standards for RTOs 2015 replaced Standards for NVR RTOs 2012 as a new regulatory
standards for education providers and regulators. In general, the standards aims to ensure the quality
and integrity of nationally recognized qualifications. All RTOs must comply with the said standards as
well as with VET Quality Framework and the National Vocational Education and Training Regulator
Act 2011 or equivalent. The Standards is comprised of eight (8) standards, wherein each standard contains a set of clauses. The
following are the eight (8) standards:
i.
The RTO’s training and assessment strategies and practices are responsive to industry and
learner needs and meet the requirements of training packages and VET accredited courses
ii.
The operations of the RTO are quality assured
iii.
The RTO issues, maintains and accepts AQF certification documentation in accordance
with these Standards and provides access to learner records
iv.
Accurate and accessible information about an RTO, its services and performance is
available to inform prospective and current learners and clients
v.
Each learner is properly informed and protected
vi.
Complaints and appeals are recorded, acknowledged and dealt with fairly, efficiently and
effectively
vii.
The RTO has effective governance and administration arrangements in place
viii.
The RTO cooperates with the VET Regulator and is legally compliant at all times
Non-compliance with these standards would possibly lead to a damaged reputation and credibility of
SSBT since it may indicate SSBT’s non-conformance in ensuring the quality and integrity of
nationally recognized qualifications. Additionally, a tarnished reputation would also affect the
marketability of the institution to domestic and international students.
NSW Work Health and Safety
Work Health and Safety Act 2011 and Work Health and Safety Regulation 2017 legislations applies to
all workplace in NSW therefore including SSBT.
The main objective of Work Health and Safety Act 2011 as stated in the Act is to provide a balanced
and nationally consistent framework to secure the health and safety of workers and workplaces by:
a)
Protecting workers and other persons against harm to their health, safety and welfare through
elimination or minimization of risk arising from work
b)
Providing for fair and effective workplace representation
c)
Encouraging unions and employer organizations
d)
Promoting the provision of advice, information, education and training
e)
Securing compliance with this act
f)
Ensuring appropriate scrutiny and review of actions
g)
Providing a framework for continuous improvement
h)
Maintaining and strengthening the national harmonization of laws
Work Health and Safety Regulation 2017 details all the duties and responsibilities of an organization
related to Health and Safety as well as the penalties (Schedule 18A) and their corresponding fees. To supplement the said legislations, an approved code of practice provides a guideline to accomplish
the required standards of health and safety welfare. Non-compliance to WHS Act would lead to monetary losses due to penalties sanctioned by the
government as stated in the Act Division 5. Offences and penalties. Additionally, non-conformance
may also lead to a damaged reputation of SSBT.
Privacy Act 1988
The Privacy Act 1988 also referred as Privacy Act aims to promote and protect the privacy of
individuals as well as how the public and private organization handles personal information. The Act
contains 13 (thirteen) Australian Privacy Principles (APPs) in the Act Schedule 1 which applies to

The organization must provide a safe plant and structures, safe systems of
work, adequate facilities for the welfare of workers, and monitoring of
worker’s health
3.1
The organization must equip its employees any necessary information,
training, instruction or supervision to protect all staff from risks to their
health and safety arising from work
4.1
Failure to comply with health and safety duty corresponds to penalty units
