Supreme Court Case Assignment
Amanda Copeland/Hughes
Post University LAW 101
SEPTEMBER, 3, The Supreme Court case I decided to look into was Mitchell va Wil
The Wisconsin police responded to a call about a driver driving in a van while to be drunk. When the police officer found the van, Gerald Mitchell was wandering near a lake. Upon his arrival the police officer identified himself and told Mr. Mitchell he was going to be given a field sobriety test to determine the amount of alcohol he had to drink. Mr. Mitchell blew a 0.24 percent, which is above the state limit for Wisconsin. Upon this field sobriety test’s results Mr. Mitchell was arrested for operating a vehicle while under the influence. The responding office placed Mr. Mitchell in his patrol car and preceded to take him to the police station to do a second breath analyzer test, which is done with much better equipment and after these results would come back the police officer would more than likely book Mr. Mitchell. While in route Mr. Mitchell passed out before receiving this more sophisticated breath test. The police officer decided to take Mr. Mitchell to the hospital to Have a blood test done to check the level of his alcohol content. Mr. Mitchell was unconscious upon arrival and the hospital staff had to wheel him in. The staff on
duty drew Mr. Mitchell’s blood and ran the test and it came back with a blood-alcohol content of 0.222 percent. This again, showed Mr. Mitchell was over the legal limit. Since both tests came back with a high alcohol content the police arrest Mr. Mitchell.

The information is presented as a timeline that starts with a briefs summary of why the case is being brought to trial and ending with the court's decision. It's not something someone with zero legal knowledge would understand easily due to all the citations that are used most people do not
even know what a citation is.
1.
Non-legal information is presented in a way that is more simplified Often times, all the information
is summarized in non-legal Information leaving out many important details. Whereas Legal information is presented in a way that is precise and detailed and shows you where you can find your information. They make citation readily available for reference.

The Supreme Court case that I decided to look into is District of Columbia v. Wesby. docket number 15-
1485. The case was argued on October 4, 2017 and the Supreme Court made their decision on January 22, 2018.
1. My general impression of how the information is presented left me very confused at first due to all the
citations anc references. However, the wording and descriptions are in such detail and explain everything. "The only other signs of habitation were blinds on the windows, food in the refrigerator, and toiletries in the bathroom" (District of Columbia v. Wesby).
2. The information is presented differently than a non-legal way because every sentence or two is a citation or a reference to another court case that had a similar situation occur, and all the details used to
describe the house and the people and their conversations is not how most people would describe the situation.
3. The terminology used is somewhat difficult to understand. There were a few words that stumped me for a while, but not too bad. It was mostly hard to follow because of the constant interruptions of citations and references, which I am sure are very beneficial to those studying case law, but it made the text hard to follow at times.
