Mackenzie Carroll LEX110-830A Module 5 assignment February 11, 2024 1. What is the difference between jurisdiction and venue? Between original jurisdiction and appellate jurisdiction? Between personal jurisdiction and subject-matter jurisdiction? What is a long arm statute? With jurisdiction, the court has the authority to hear and decide a specific case. As for venue, the geographic district where an action is tried, and the jury is selected. Original jurisdiction is when the court has the power to take a case, have a trial, and then decide the outcome. This is different from appellate jurisdiction where the court has the power to hear and decide an appeal or to review cases that have been tried in a lower court. A long-arm statute is a state statute that allows a state to gain jurisdiction over nonresidents. This is based on activities that took place in said state. 2. Describe the types of cases over which federal courts exercise jurisdiction. One type of case in which federal courts have jurisdiction is one that causes a federal question. A federal question is a question that has to do with the U.S. Constitution, acts of courts, or treaties. This aligns with Article iii, section 2, of the constitution. Another type of case is any case involving a diversity of citizenship. Diversity of citizenship may arise between citizens of different states, a foreign country and citizens of a state or different states, or citizens of a state and citizens of a foreign country. 3. Describe the various methods of alternative dispute resolution. There are three types of alternative dispute resolutions. They are negotiation, mediation, and arbitration. Negotiation is a process where parties attempt to settle their dispute. They can do this with or without attorneys. Mediation is a way to settle disputes outside of the court by using a neutral third party to communicate between the parties involved. Arbitration is another way of settling a dispute. It is like mediation, but in this method, the third party decides the outcome.
