Functions and Processes Related to Sanctuary Cities
Law Enforcement
Courts
What They Do
Enforce state and local criminal laws for those who are suspected of acting in a crime. Provide overall safety for all, whether documented citizens or not.
The courts responsibility is to ensure justice and make determinations for law and order.
Jurisdictional Issues
Typically law enforcement tries to act as ICE and not carry out their own duties as
the law dictates. When handling undocumented immigrants, in some 'sanctuary cities' it is encouraged to not cooperate with federal agents.
The courts are very black and white, where there is little to no grey area. Some argue that the courts should see both sides and offer flexibility especially when identifying punishments for acts of crime.
⦁
Describe how the U.S. law enforcement and court systems function together.
We would not have a criminal justice system if there were not laws or policies in place. Law enforcement is responsible for maintaining order and identifying those who disrupt the peace or commit a crime. The courts identify what punishments are suitable for crimes committed. It takes collaboration from both sides to function together.
⦁
Include at least one dysfunction or challenge area.
One dysfunction or challenge for law enforcement and the court systems what can be upheld in court. Ensuring each arrest is properly handled, individuals are questioned, and read Mirranda rights. Local law enforcement in some cases does not comply with the courts especially in 'sanctuary cities'.
Follow-Up Questions
Answer the questions below in two to five sentences in order to elaborate on the process represented in the graphic organizer above. Use examples from the article provided in the Module Four Assignment Guidelines and Rubric to support your responses.
⦁
Identify the functions of law enforcement related to sanctuary cities in the resources provided. What is law enforcement allowed to do, according to Senate Bill 4? What impact or lack thereof has the law had on police operations? According to Senate Bill 4, states that officers do not need to ask the immigration status. The officers only need to ask questions when they feel it is warranted. It is important to note that local law enforcement should not be the one to ask immigration questions, as it is not their role to enforce what U.S. Immigration and Customes Enforcement is intended to do. Senate Bill 4 also intimidates officials with repercussions such as jail or fines when they violate the law. ⦁
Identify the functions of court systems related to sanctuary cities in the resources provided. What did this US Court of Appeals for the Fifth Circuit do? What Constitutional issues may arise? The US Court of Appeals for the Fifth Circuit modified the law for elected officials. Only certain positions within the government are protected. Constitutionally there is concern with violating the First
Amendment right because employees of the city feel controlled with the law enforced. ⦁
Describe how the U.S. law enforcement and court systems relate to sanctuary cities using information from the resources provided. How did they respond to shared issues? What is at least one challenge area
for the police in relationship to holding detainees? One of the challenging areas for the police when it comes to holding detainees is the severity of the infractions. In the CNN video, it was identified that in 'sanctuary cities' ICE was deporting people for minor infractions (YouTube, 2016). If the individual does not have a criminal record, ICE will allow them to be released back out to the community. References
