CHCLEG001 Work Legally and Ethically legal implications. You must comply and adhere to policies and make sure that you are qualified to perform the job. At any stage that you are not trained or not competent in performing the task you must immediately inform the supervisor in charge. Failure to do so can result in injury to your client, colleague or yourself. Your manager will normally provide training to make sure that all employees are fully competent in their job role. If you perform the task that is beyond your limit this can harm the client as well as the employer as legal actions can be taken against you and your employer. When a position becomes vacant and an employer is advertising for a certain position, a duty statement is created by consulting legislation, service standards and policies relevant within that job role. It is the employer’s responsibility to make sure that they fill the role with the correct person that fits the legal requirements in that job role, making sure that you have the skills and the knowledge and the correct qualifications to perform the job. If unsure about the legal boundaries of your job, you can always seek clarification from supervisor and manager but you can also seek external advice from professional organisations like Australian Community Workers Association (ACWA). It's important to be aware of your legal responsibility and implications of negligence. As there could be times where complex situations could arise that might require consulting an external legal practitioner to help resolve any issue. There are some facilities that are already affiliated with legal practitioner and they can be used to query on advices or the legal rights of employer and legal responsibility. But obviously an employee can choose to have their own legal advice independently. Community centres can also offer free initial advice and affordable legal support.
