Week 3 Should the US Military or other US Federal agency conduct surveillance and collection within the United States, without a warrant or other legal means, at any time? What about outside of the United States at any time on American citizens? Should the various law enforcement agencies found at state and local levels be able to conduct surveillance and collection within the United States when they have a warrant, but also be able to do it when they do not have a warrant? Surveillance is an imperative part of military and Federal agency operations. They have implemented dynamically sound Artificial Intelligence that is capable of detecting adversaries/personnel without using the human factor. There are different types of surveillance that are utilized that include Human Intelligence, Open-Source Intelligence, Signals Intelligence, and more. Within the United States, I do believe it is essential to utilize surveillance because there are insider threats, homegrown violent extremist, and other adversaries that threaten our National Security. However, I do not believe that they should conduct surveillance without the warrant at any time. There should be probable cause on to why surveillance is being conducted on a certain person. There have been examples of the government collecting surveillance on U.S. citizens in lieu of Executive Order (EO) 12333. This EO has allowed the Defense Department to collect intelligence without the use of a warrant due to the plain text in the order ( U.S.: New Evidence Suggests Monitoring of Americans , 2017). This not only violates the persons Human Rights, but it also puts the faith in the Defense Department operations in jeopardy. I also do not condone in the collection of surveillance on American citizens outside of the United States. I previously stated that collecting of such surveillance violates human rights, and it is the same for collecting it outside of the U.S. There are international laws against collecting such surveillance and if desecrated could jeopardize the relationship. To obtain a warrant to collect such evidence and surveillance on an individual means that they had enough evidence/probable cause to go before a judge to be granted a warrant to conduct their operations. If this is the case, I do believe local law enforcement agencies should be able to conduct surveillance to collect evidence regarding their operations. Surveillance without a warrant is something I do not believe is something that should be authorized by anyone at any level. Some Human Intelligence gathering techniques include espionage and interviewing individuals. Some Open-Source Intelligecne gathering techniques include gathering information on social media and through the internet that is viewable to the public ( Intelligence Studies: Types of Intelligence Collection , n.d.). These surveillance techniques should be warranted as it is information gathered through interviews and sources that are viewable by anyone.
