Note this and the other memos will be used to prepare your final project memo. 11. Storm sewer projects Lexington What is the policy or project? o Explain the issue you are analyzing. Provide background information so the reader can understand this issue. o Who is advocating for or against this topic? What arguments to the make? The issue that we are preparing to analyze is storm sewer projects in Lexington, KY. Storm sewer projects are essential to every resident in the Lexington area. This project is crucial in the fact that stormwater is rain or snow that could not be absorbed into the ground and therefore require drainage systems that discharge the overflow into creeks and streams through these systems. This is critical in rerouting the flow of stormwater, as according to quality control of Lexington, when stormwater washes over roads, yard, and roofs, “it picks up pollutants such as motor oil, pet waste, fertilizer, and litter. The arguments being made for incentivizing these projects through grant programs provided by the Lexington government. The Water Quality Fees Board recently selected recipients of this grant through applicants, with four projects receiving anywhere from $7,000-$40,000. The projects create inclusion amongst the board that must collaborate with schools, churches, businesses and non-profits and Lexington aims to not only improve their capture of stormwater but the quality of our water systems itself. What is the relevant perspectives for the analysis (global, national, state, local, others)? o Consider what level of government has the authority to authorize the project/policy? o In some cases, the decision could happen at different levels of government. The relevant perspective of this project is at the local level. The level of government is completely based around the city of Lexington and does not pertain to any other outside counties or cities. The authority in place for these projects are those within the Division of Water Quality, with the director being Charles Martin. Martin recently approved an $8.2 million sewer improvement project along West Hickman Trunk E Sewer. These projects are to improve only Lexington and will not benefit any factors outside of residents within the city. If standards for the state of Kentucky or the U.S. as
a whole were to improve, then the city government would hold no power as their authority would be overturned at the state and federal level. We see this happening about midway through 2023, as EKY requested $86 million to prevent any flooding to the extent of what happened in July of 2022, where over forty Eastern Kentuckians were taken, and schools and businesses were wiped out due to the flood. This is a great example of a local government agency seeking higher authority for assistance in preventing another natural disaster in their region. Who has standing? o Why do they have standing? o Who could be affected but not have standing? o How will the impacts to those without standing be treated in your analysis? Those with standing relates to the Water Quality Board of Lexington Kentucky. Their aim as an agency is to not only improve water quality in the Lexington area, but also manage excess stormwater and create safety whether that be during travel or residing in Lexington as a whole. Those affected without standing are residents of the area. These are your everyday people that major flooding can severely affect whether it be travelling conditions which can affect ones ability to work, along with overall safety while at home. The impact on those without standing seems to be the most crucial part. How are residents in the are directly affected by flooding, and how does the pollutants within the water indirectly affect them as well? These are my main two questions I hope to answer in terms of standing when related to sewer projects within the Lexington area. What are the likely impacts of the policy or project? The impacts of this project affects not only people but the environment as well o What are the appropriate measures for these impacts? Could there be a market failure? o What type? o What contributes to the market failure? o What does this mean for allocative efficiency? Generally, how does the policy or project affect consumers, producers, and the government revenue?
