Summary:
TEST OF CONSTITUTION states “The right of the people to be secure in their persons,
houses, papers, and effects, against unreasonable searches and seizures, shall not be violated,
and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and
particularly describing the place to be searched, and the persons or things to be seized”.
In other words, The Fourth Amendment safeguards all citizens from arbitrary government
searches and seizures. Unfortunately, only the search and seizures that are ruled legally
unjustified are protected. Searches and seizures are illegal if it happens without consent, a
warrant, or probable cause to believe that a crime has been committed. Search and seizure
require law enforcement officers, such as the police officers, to be present. This allows all
citizens the right to privacy within their bodies, houses, papers, and properties, if there is no
probable cause that a search and seizure is necessary.

A real-world example would be that there was a warrant to search your vehicle. If the warrant
states that your vehicle be searched, they cannot search you house, too. Unless, for instance,
there was narcotics sighted in the open, in your garage that your vehicle is in, they have every
right to search the remaining premises of your garage. If they were to find more substances, it
can and will be used against you, legally.

If the police cannot provide enough evidence to get a judge to sign a search warrant,
the police department may have to drop the case until they are able to provide enough
evidence to judge that there is probable cause for the search.
Evidence that are collected/confiscated during a search without a warrant may be
inadmissible due to not having a search warrant available at the time of the search.
There is a protocol that has to be met when collecting evidence during a search, and
that includes having the warrant before the search takes place.
Unless a judge is approached with hard evidence, not gut feelings, he/she cannot issue
a warrant legally. If the judge is approached and there is no evidence proving that a
crime has been committed, and the judge still issues a search warrant, it is illegal.
