One discretionary decision made by the judge
in the scenario was to sentence the student
from Elite Educational Institution in California
to six months for committing a rape crime.
The sexual assault case had violated some of
the Penal Code Requirements of California,
which states that any defendant accused of
rape crime shall be sentenced to jail
imprisonment of between three years to
eight years (California Legislative Information,
2013). However, instead of using the laws
provided for this kind of crime, the judge
decided the sexual assault case by sentencing

both the defendant and the victim. The
decision positively impacted the defendant
because the student got a jail sentence for six
months instead of 3 to 8 years in prison

Additionally, the student would have a
chance to complete his education. On the
other hand, the decision negatively impacted
the victim because the victim did not get the
justice deserved from the rape committed.
