The Uncorked Paintbrush: A Workplace Investigation
Statement of Situation & Workplace Plan Tony, an employee of The Uncorked Paintbrush
has filed a report to HR in regards to an incident that took place last Saturday at a party thrown by The Uncorked Paintbrush
. In order to accurately get both perspectives of the incident, I would like to speak to Tony, the employee who
filed the complaint, Tanya, the manager of The Uncorked Paintbrush
, any employees who worked the night of the party, and any customers that were at the event last Saturday. All of these
witnesses are vital to the investigation as they all were present the day the party happened and when people got sick.To gain the most information from the participants, it's imperative to make sure all questions coincide with another, and that questions are related to the person and topic at hand only to stay away from any personal or outside biases. Some of the questions that will be asked to conduct the interview are as follows:

How was your day at work the night of the incident? (Tony)

Did any employees get sick or just customers? If so, which employees? (Tony & Tanya)

Did you see the bag of chemicals outside that Tony brought up to you? (Tanya)

Investigation Process & Findings
Witnesses that were interviewed for the investigation was Tony, Tanya, Logan, Jessie, and Grace

Tony
-
From the interview with Tony, one can conclude that he provided credible information from what he witnessed at the business that night. He also provided some details about previous issues that caused him to file complaints to HR, including safety and training issues. He detailed what he observed at work prior to people getting sick, which was he saw the usual routine at the job, everyone interacting and helping the customers. At the end of the event, he cleaned up the stations, like he usually does and took the trash out. He saw a mysterious bag of harmful chemicals next to the trash that should not have been there. Next day he asked Tanya about the bag of chemicals outside and if the chemicals were used for her paints. She denied seeing the bag, got upset with Tony for accusing her of
being the reason people got sick and fired him, once he notified her about him going to HR to look into the situation. -
Personal biases: I think the two let their friendship get in the way of them being able to work efficiently together. Tanya took her hanger out on Tony, and got offended because he was her friend. -
Wanted to see the bag of chemicals, or at least a photo of them, but Tony did not have either

From the interview with Tanya, one can conclude that she may be leaving out certain details, or did not tell the full truth of what she saw and what happened that night. She alleges that Tony accused her of putting something harmful in the paints and that is what caused people to become sick. Tanya says she is passionate
about what she does and would never put anything harmful in her products with The Uncorked Paintbrush
being an eco-friendly establishment. She was around the paints as well as around the establishment the day the incident happened, although she did not see anything unusual or suspicious. Tanya pointed out how her paint products are made with all-natural and herbal ingredients, so nothing chemical related that could have gotten anybody sick. She did not see the chemicals that Tony mentioned to her the following day, but she did say she was upset about his accusations against her, which is what caused her to fire him. The two had no prior issues according to Tanya. -
Personal biases, I looked at Tanya differently for firing Tony out of anger. The situation could have been addressed differently, and did not have to end with someone being fired, when they have done nothing wrong. Tanya
is the manager of the facility, but has not reached out to any customers, or staff members to get updates, why? She should be more concerned with the incident that took place at HER facility, as she could face severe legal action for what happened to the customers and staff. I also feel as if Tanya
is lying about not seeing anything, as a manager she should be present for those kinds of events, to ensure things are running smoothly. -
Logan

After conducting the interview with Logan, it can be concluded that the information provided from Logan was credible. Logan provided details of what she saw, which is similar to what was reported by both Grace and Jessie. Logan says she was around the paints, just like the other employees and guests, and she also had some food and wine. She was fine until the end of the event where she began to feel super sick. She ended up having to go to the hospital where she was told that she had arsenic in her system. Upon further research, Logan does not know where exactly she came in contact with arsenic because one can be poisoned with it in various ways. Logan did make note that the wine she drank
was not provided by her job, but rather was brought in with a guest who also attended the event that night. -
What made me look at Logan differently was the fact that she was drinking wine. It is against the policy of the company for employees to be drinking on the job, so why drink when you aren’t supposed to be? -
Jessie

From the interview with Jessie, it can be concluded that the information that she provided was credible and follows the overall common agenda of what happened that night at The Uncorked Paintbrush. Jessie recalls being called into work that night because it was her day off. She said there was a lot more food than usual, and she did have some while working. In addition to eating while she was working, she said that a customer had brought some wine that was made in their basement that she drank. She describes the wine as tasting good, and really helped
her enjoy the shift. Jessie recalls everything running smoothly and as it usually does, until the end of the night when she began to feel sick like Jessie. After being
taken to the hospital, Jessie was told she had food poisoning, so she was not as “bad off” as Logan. Not sure how she got sick because she ate and drank the same
things as anyone else who ate or drank that night. -
The personal biases I had for Jessie are the same as the ones I had for Logan. If employees are not permitted to drink on the clock ,those two should not have been drinking regardless of the type of party it was. It was
work for them, and they were there to work, not linger. I also don’t think it
was smart on Jessie’s end to drink the wine after being told that a customer made the drink in their basement. -
Grace

After briefly speaking with Grace, I think the information she gave was credible and truthful. We asked Grace questions about what she saw that night and her observations match up with the other people that were interviewed. Grace came in
contact with the paints, she did not drink any wine, but also did not get sick. Grace ended up being the person taking Jessie and Logan to the hospital. Grace does not know if she was the last person to leave the establishment because she was more concerned with getting her friends the adequate care they needed. Grace
only works on the weekends, so she does not have any further details in regards to
typical, weekly, business operations. Conclusion of Investigation
Based on my findings and from the interviews conducted, I think a further investigation needs to be done with customers that were present that night. Food and drink that was brought in needs to be looked into, because there is potential for foul play in one of the products brought in from a customer, that could be the item that caused people to be sick. There is not sufficient evidence to rule that the paints made by Tanya contained anything harmful that would cause customers and employees to be sick. Only certain people got sick even though a vast majority of

the people at The Uncorked Paintbrush came in contact with the paints at one point or another. Regarding the parties involved, it would be best to look into what everyone ate and drank to see if there is a common product and move forward with investigations from there. I do not think any
foul play was conducted on the side of management and staff, but a customer may have brought in an item that had been tampered with, thus causing the illnesses that struck some people. Recommendation for Future HR Action
What HR should do in the future, is first do an assessment of the employees. There is a reason why Tony was complaining to them about issues he was observing, so it would be most beneficial to everyone if HR looked into it. If it is found that people are not following or working
to company standards, retraining for employees needs to happen to ensure everyone is working to the standards of the business. In terms of the incident that happened Saturday night, the Human Resources department should reach out to customers that came that night and interview them to see if they saw anything suspicious or anything that doesn't match the story of the employees. A piece of evidence that could help the case is samples of the wine and food that was
served. People may have gotten sick from an ingredient that was put into the drink or the food. Moving forward, The Uncorked Paintbrush should implement a policy that prohibits customers from bringing in outside food or beverages to the events. SUpplying the food AND drinks can ensure the safety of all parties involved.
