Bus-206 October 14, 2023 Tort Law Dynamic Business Law defines tort as “a wrong or injury to another, other than a breach of contract” (pg. 195, 2020). Tort law deals with civil law (excluding contract law,) including civil lawsuits. This area of the law consists of providing relief to those who have been harmed, usually providing monetary compensation. Tort Law has 3 main categories including: negligence, deliberate damage or injury, and liability. Tort law helps reduce negligence and unlawful acts by businesses. There are 5 types of law that affect businesses specifically, which include: disparagement, intentional interference with contract, unfair competition, misappropriation, and fraudulent misrepresentation. Jasmine, owner of Sunshine Yoga, has been complaining to landlord Lou about the loud noises coming from the business next door owned by Dave, which has resulted in the loss of customers. On top of that she suffered a heart attack as a result of a sneak scaping from Dave’s business (The Friendly Dawg) and sneaking into Jasmine’s yoga studio. Jasmine could seek monetary compensation to cover for the medical expenses and mental anguishes caused by the event because in this scenario the tort laws of negligence and liability apply in the situation. Even though, Dave did not mean to harm Jasmine, he failed to set the proper precautions and secure the sneak adequately in order to avoid any kind of accidents, which resulted in the sneak scaping into Jasmine’s studio, which led to her having a heart attack.
Due to Dave’s and the Landlord’s negligence, Jasmine lost customers, had a heart attack, and is facing some mental health problems; therefore, she should be monetarily compensated for her losses and medical bills.
