Societal Trend in Criminal Justice Brief Description How the Trend Affects the Public How bail reform impacts the criminal justice system and the community? It is particularly evident when it comes to criminal justice (CJ) that there is a disparity in wealth in our society. By establishing Pretrial programs for those awaiting trial who cannot otherwise afford bail, bail reform addresses this disparity. If an individual is involved in a pretrial program, they are likely to be required to check in regularly with a case worker as well as to attend reoffending prevention programs. This helps to reduce the likelihood of them committing a crime while awaiting trial. Additionally, bail reform also helps to reduce overcrowding in CJ facilities, which can be costly for governments. Furthermore, bail reform can help to reduce recidivism rates. Bail reform can also free up resources to focus on more serious crimes and other important issues. Additionally, bail reform can encourage more people to accept plea deals, as they can be released early if they plead guilty. The programs and the individual’s participation in case management are designed to both protect the community and the accused (Schlesinger, 1986). 2020, during a pandemic and civil unrest, saw a dramatic increase in the public’s rallying cry for Bail Reform (Gold & Wright, 2020). There have been bail reform laws in our society since the 1960s, under the pretext that they would improve the lives of the poor and reduce the number of criminal suspects who were in prison (Walker, 1993). Following the death of Breonna Taylor and George Floyd in 2020, the movement became more popular than ever before. People who are arrested are placed in pre- trial detention, which has a great impact on their families, and this hurts racial disparities (Gold & Write, 2020). Additionally, pre-trial detention can jeopardize employment, housing, and parent-child relationships (Gold & Write, 2020). As a result of bail reform, people can continue to be productive citizens as well as to contribute to society. A reasonable interpretation of the Bail Reform would be that many 'career criminals' who benefit from it did not have employment, housing, or child custody issues that they were concerned about, so such a statement would be of minimal relevance. A person on pretrial case management can directly affect the public in that they may suffer from victimization. If suspects awaiting trial are housed in hotels, such as those in San Francisco, the cost of excessive pre-trial monitoring is often greater than the cost of detention.
