The bankruptcy case In re Roberts was resolved in 2011 by the United States District Court for the Northern District of Iowa. The case featured a debtor who had a homestead in California but lived in Iowa. The debtor filed for Chapter 7 bankruptcy, and the trustee tried to sell the debtor's California homestead. The debtor objected, claiming that the property qualified for the Iowa homestead exemption. The court ruled that the Iowa homestead exemption applies extraterritorially in bankruptcy and that the debtor was not compelled to sell the property in order to pay his creditors.
