When someone isforced to do something against his or her will, that person have been  have been the victim of dures. There are two types of duress: physical duress and duress by improper threat. A contract induced by physical violence is void.

There are 2 types of actions that can signal the lack of mutual assent. Duress, also known as coercion, is when one person intentionally manipulates the other person to enter into a contract either by force or pressure.
Another action that signifies the lack of mutual assent is undue influence, which occurs when one person uses its power over the other people to manipulate them into signing a contract.

The main difference between duress and undue influence if is there is a direct threat versus excessive misuse of power
