2 History and Landmark Court Decisions History and Landmark Court Decisions “Brown v. Board of Education of Topeka was a landmark 1954 Supreme Court case in which the justices ruled unanimously that racial segregation of children in public schools was unconstitutional.” (“Brown V. Board of Education: Summary, Ruling & Impact,” 2009). This ruling comes at the height of the civil rights movement, fighting for equal rights of African Americans in the United Stated. The National Association for the Advancement of Colored People (NAACP) were working to challenge the Supreme Court rule in Plessy v. Ferguson allowing for segregated of public facilities, as well as pushing back on the Jim Crow laws that stated, “separate but equal”. When Brown v. Board of Education of Topeka went before the U.S. District Court in Kansas, the court agreed that the segregation of public schools had detrimental effect on color children and “contributed to a “sense of inferiority”, but still upheld the “separate but equal” doctrine.” (“Brown V. Board of Education: Summary, Ruling & Impact,” 2009). Once the case reached the Supreme Court the chief justice ruled that the ‘separate but equal’ was indeed unequal and the plaintiffs were being deprived of their rights protected by the 14 th Amendment. The overturning of Plessy v. Ferguson was a major milestone in American moving forward towards equal education for both black and white students. The SCOTUS at the time was affected by societal mores and beliefs of the civil rights movement. After the ruling the flood gates for civil rights in the south opened and led to boycotts, sit-ins, protests, and demonstrations. These movements lead to the end of the Jim Crow laws and the passages of the Civil Rights Act of 1964, the Voting Rights Act of 1965, and the Fair Housing Act of 1986. The Supreme Court ruling on the Brown v. Board of Education was influenced on societies desire for change. In society Laws are created an upheld to protect citizens and provide guidelines for ensuring human rights and maintaining order. These laws affect society by providing a basic outline on have society should behave and act. The laws are to be upheld for every citizen without bias or discrimination. Society and social movements can affect the Constitution and how it is interpreted to societal issues. Amendments to the Constitution are created to adjust to societies issues and stance on social issues.
3 History and Landmark Court Decisions Forensic psychology is, “the use of psychological knowledge or research methods to advise, evaluate, or reform the legal system.” (Costanzo & Krauss, 2020). In the court system psychologists are often used to advise on the legal system. In the case of Brown v. Board of Education, I believe a forensics psychologist would support Brown. The issue of the case is that separate but equal is not equal. The psychologist might support this side as in an evaluation research capacity. “Most evaluation research asks questions about a specific legal practice or policy.” (Costanzo & Krauss, 2020). In this case the legal practice is the segregation of colored students. The racial separation of students would be viewed as unethical and unfair. Colored students were being negatively affected by the segregation. Many students were forced to endure long bus rides, overcrowding, inadequate supplies, and insufficiently paid teachers. “ Such disparities resulted in gaps in the educational opportunities available to Black and white communities.” (“Impact of Classroom Segregation on Student Education | American University,” 2022).
