Professor and Classmates, The difference between mediation and arbitration, as well as the pros and cons of each, are as follows: Mediation is a process in which a third party is used to resolve an issue between two or more parties. A Mediator is utilized as a facilitator to support the parties in coming to a mutually agreeable solution. This is typically the case for married couples who are divorcing and cannot agree on the terms of the dissolution of their marriage. Also very common for custody agreements, among many other topics. This is common as a cheaper and mutually beneficial option than going to court and having the judge decide for the parties. It may also keep the issue out of the public eye and provide privacy for the parties. This type of conflict resolution only works if the parties are all willing to participate for the better. If any party is unwilling to bend, the solution will typically not be found during mediation. Arbitration is a form of ADR, Alternate Dispute Resolution, and involves the parties agreeing not to take legal action but use a third-party decision maker. This is someone paid to find the resolution that best fits the situation, but neither party has any control over the final decision. This is more likely beneficial for those unwilling to bend but agree that legal action is also not beneficial. While both are very similar in involving an unbiased middle person, one has more common ground than the other. The arbitrator is the judge and jury, while a mediator is just the middle man to find common ground. Remote work arrangements alter the conflict landscape, based on this week's e-reading, by preventing face-to-face conversations, open communication, and more opportunity to misjudge what people are saying. Everyone knows that humor and sarcasm can be difficult to convey through email; well imagine all your communication with a co-worker is through email.
