Bri Metzger POLS 110 18 October 2023 Many people don't understand how the Executive Branch is divided up. For example, the President holds certain powers whereas the office of the President holds other powers. It is not a one-man job like many believe. The Executive Branch is led by the President and the cabinet works under him to make the Executive Branch run smoothly. Due to this, I believe the President is more powerful than the Executive Office. In Article II of the Constitution, three main powers are outlined for the President. The first is Executive Power. Executive Power allows the President to appoint and supervise all Executive Officers and Federal Judges. It also allows the President to execute laws. This means he/she holds the power to decide which laws they want to enforce and how said enforcement will be carried out. The Insurrection Act of 1807 added to the Executive Power of the President by granting them the right to call into service the U.S. Armed Forces and/or the National Guard. At the request of a state governor, to protect federal property or enforce federal laws, and in cases of unlawful obstruction of justice are the ways the President can use the power from the Insurrection Act. The second power outlined in Article II is Military Power. This is what makes the President the Commander in Chief of the U.S. Army and Navy. The original scope of the President’s role as commander-in-chief was just to command troops to defend the U.S. against invasion and attacks but it has since been broadened. The Gulf of Tonkin Resolutions and the War Powers Act gave the President more military authority but also prevented the President from declaring war and limited the engagement of U.S. troops without a formal declaration of war which can only be done by Congress. The third power outlined in Article II is Legislative Power. Legislative Power is the President's power to veto bills, influence the issues Congress focuses on, sign bills into laws, enact Executive Orders (orders in place when there is an absence of legislation on the topic), and pocket veto power (if a bill is not signed into a law in ten days it is automatically vetoed).
Bri Metzger POLS 110 18 October 2023 The Executive Office of the President is what Americans know as the cabinet. The cabinet consists of the heads of departments that assist the President in running the country. It is important that these heads stay loyal to the President but still maintain fair and loyal to their purpose as well. The cabinet is sometimes referred to as the President's toolbox because of what their powers are. Some of these powers include providing the President with expert advice and counsel on various matters, coordinating and implementing the President's policies, managing the President's communications and public relations, and helping manage and respond to crises. There are some clear differences in the powers of the President versus the powers of the Executive Office of the President. While both powers are outlined, the power they hold is vastly different. The President does not report to anyone while the office reports to the President. The Executive Office’s powers are limited to the President's agenda. They assist the President in a multitude of ways but generally cannot do much with their powers outside of the President's actions and decisions. Hence, the President is more powerful than the Executive Office of the President.
