All individuals residing in the United States, irrespective of their immigration status, are entitled to the rights of equal protection under the law and due process as guaranteed by the United States Constitution and the Bill of Rights. Undocumented immigrants possess same constitutional safeguards as citizens, encompassing the entitlement to privacy, equitable treatment, freedom of expression, and freedom of religion. The proportion of the U.S. population that consists of individuals who were born in another country is approximately 41%. The yearly expenditure for incarcerating undocumented immigrants in the United States amounts to $1.84 billion. Refugees and immigrants are obligated under international human rights laws to adhere to the laws of the nations they have moved to. Individuals who are refused the right to live in another nation should be granted fundamental procedural rights, such as the chance to submit their arguments in a formal hearing. In 2013, over 83% of those who were instructed to leave the United States did not get the chance to present their case in a court of law. 2. The initial inquiry to make is regarding the individuals who are affected and the specific way in which they are negatively impacted. The broadening of immigration rights in the United States could potentially have an adverse effect on the labor market for native-born Americans. The influx of numerous newcomers has the potential to jeopardize the job security of the existing population. Immigrants may access the low-skilled job market by being willing to accept reduced wages. These individuals who were born in the country and have limited education and experience may encounter challenges in securing employment in more specialized industries. 3. Regarding b, please explain your level of involvement in the issue. After an extended period of time residing here, I have reached the determination that a significant influx
2 of new individuals can exert financial strain on public funds. Immigrants and non- citizens encounter a disparity in their rights compared to the general population. I am concerned about this matter because I believe it is important for them to be afforded equal safeguards and freedoms as all other individuals inside the nation. 4. 4. Which level of government is implicated (federal, state, municipal, or organizational)? c. There is a pervasive concern regarding the immigration issue throughout the nation. The United States extends an invitation to individuals from all corners of the globe to immigrate to the nation. Hence, it is imperative to pass legislation that will effectively govern, oversee, and safeguard immigrants, while simultaneously ensuring the provision of these rights to all immigrants. I aim to advocate for this cause by striving to ensure that all immigrants are granted equal safeguards. 5. Who is presently attending to this issue? In order to address prejudice and discrimination towards immigrants, the American Civil Liberties Union (ACLU) has created the Immigrants' Rights Project (https://www.aclu.org/issues/immigrants- rights) with the aim of protecting and upholding the civil liberties and civil rights of immigrants. The American Civil Liberties Union (ACLU) use strategic litigation, education, and advocacy to protect the civil and human rights of immigrants. 6. 7. The ACLU has consistently prioritized advocating for the legal rights of immigrants. The organization advocates against legislation that seeks to restrict immigrants' ability to seek legal recourse, impose indefinite detention on them, or engage in discriminatory practices based on their nationality. In addition, we have actively opposed unconstitutional enforcement measures implemented by federal, state, and local authorities, such as the "show me your papers" legislation enacted by multiple states with the intention of singling out immigrants. 8. Who holds influence over this issue, and for what reasons? Congress has exclusive jurisdiction over matters pertaining to immigration, citizenship, and other foreign policy issues. The Constitution of the United States grants Congress the power to establish consistent standards for citizenship. Although these articles do not explicitly grant jurisdiction, the Court has historically seen immigration as an inherent power derived from the foreign policy authorities of the branches. 9. 10. a) Which structures are involved in this situation? Although immigration policy falls under the exclusive jurisdiction of the federal government, states and municipalities have independently initiated programs to facilitate the integration of newcomers into American society. 10.
