1 While reading the contract of Vanderbilt University and the Laborers international, I know that I need to find out a couple of answers before I would go ahead and file the grievance for Frank. One of the first questions is did Frank and his supervisor have any meeting afterwards to discuss the grievance to resolve this problem quickly and informally as in Article 11 section 2 of the contract. (Grievance Procedure, pg. 1) The next questions are if frank has more than his 150 hours and are children covered under sick time? How long before his shift started did Frank contact his supervisor? Lastly what is Franks sick time use record? " (Sick Leave Provision, pg. 1,2) The cause of the grievance, the date the act occurred, and the precise type of the act are all required under the terms of the contract between Vanderbilt University and the Union. The answers to this step can be found in Frank's letter, where he describes how management declined to provide him sick leave that Tuesday morning. What particular provision of the union contract was broken is also required under the policy. Once more, Frank claims in his letter that he was not receiving sick pay, in accordance with Article 13. Finally, the employee's desired outcome must be provided by the company in order to address the problem. Frank talks about this as well when he says he wants to be compensated for the day he missed of work to care for his ailing child. (Grievance Procedure, pg. 2) Frank's note does not indicate whether he has collected 150 hours of sick leave, therefore I would also need to find out if he has. Finally, I would like to know the precise day when Frank's boss was made aware of the grievance. Employees are required by Vanderbilt's grievance system to submit a grievance with their supervisor within "seven (7) calendar days after the employee knew, or by reasonable diligence could have known, of the facts giving rise to the grievance." (Grievance Procedure, pg. 1) There were no precise dates mentioned in Frank's note. Frank claimed he had to take a sick day on Tuesday, but that does not imply he knew he wouldn't get paid for the day nor if he called in one hour before the start of his shift. In any case, to find out if the seven calendar days were up, I would need the specific dates. I would need to look into the dates of the occurrence, how Frank addressed his supervisor, whether it happened within seven days, and whether they had a meeting to discuss the grievance before he filed, based on the information in the letter. Frank's right to reimbursement for sick leave at Vanderbilt University isn't complete. The child must fit into the qualifying family category in order for the employer to cover the cost of a sick day, which he does not as being a nephew. Furthermore, there was no way to determine if seven calendar days had gone because no precise dates were provided. Frank would have lost his right to file the grievance if that time has elapsed.
