1. Research a statute, administrative rule, or court case that is not included in the textbook or in the lecture slides/lecture notes. I decided to research the court case Roe v. Wade. Roe v. Wade was an important court case that brings up many questions still to this day. Speaking of current trends, Roe v. Wade has been a crucial topic brought up recently this year. 2. Provide a brief summary (a paragraph is sufficient but the more explanation the better): (2)(a) What is the statute, administrative rule, or court case? (2)(b) What subject or textbook chapter is the statute, rule, or case relevant to? (2)(c) What is interesting about this statute, rule, or case to you such that you think it should be included in the course content? (2a) Roe v. Wade was a court case that had the right to an abortion brought up. The states now could regulate abortion, and characterized abortion as something that was covered under constitutional rights of privacy. The U.S. Supreme Court made the decision that the Constitution of the United States protects a pregnant woman’s liberty to choose to have an abortion without excessive government restriction. The woman who challenged the right to terminate an unwanted pregnancy was Jane Roe. Jane Roe was a woman who had two other previous children who she had to give up for an adoption because she couldn’t support them. On the other hand, the man who disagreed with Roe’s challenge was Henry Wade. Henry Wade tried prosecuting Jane Roe for seeking an abortion when state law permitted termination only if the woman’s life was in danger. (2b) I’d say this court case is relevant to how women prevent pregnancy today. There are now forms of birth control, IUD’s, and other methods of preventing a premature or unwanted pregnancy. Back to when Roe v. Wade was relevant, women didn’t have many options of preventing an unwanted pregnancy. They would more often than not have to go on with giving birth to the child, then eventually giving it up for adoption. Women could typically not afford one to many children back then, as they can today. An abortion today is way more common than it was back then, and that’s where I see the changes of women being able to decide their future on the matter. (2c) I find it interesting that women had little power over the decision to give birth or not. Typically, it should be the woman who’s giving birth the choice whether or not to keep it. There are many factors that play into whether that child will have a supportive life or not. If the woman giving birth couldn’t afford the child, take care of the child, or provide the daily needs for the child then there’s a decision on whether or not the kid could survive this life. On the other hand, if the woman could support it, take care of it, or even have enough money to afford it then they should have the choice on whether to keep it or not. I feel as if we could learn that men were trying to tell women that they couldn’t decide what to do for their own bodies, which led to a huge argument. We need to learn how women and men handle situations that’s out of one's control or not.
