8. 10 Erwin is charged with statutory rape which is defined as having sex with a minor, a person under the age of 18. Erwin argues: “You can’t arrest me just because she’s 17 and I’'m 21. Yes, we had sex, but it was consensual, plus she will be 18 in two weeks, and we are planning to get married.” Which of the four tests of worthiness does Erwin’s argument fail? Explain your answer. a. Erwin failed the test of truthfulness By law the teenager is under the age of 18. Even though it is true that she will be of the legal age of consent in two weeks, she is still considered a minor at the time of sexual intercourse and by law, that make is statutory rape. Go to the Individual Exercises at the end of Chapter 7 and evaluate example 4, which begins “If god intended marriage...” Assume the premises are true. Applying only tests 2, 3, and 4 (logical strength, relevance and non-circularity, what condition of worthiness and reasonableness does this argument not meet? Explain your answer. a. If god intended marriage for the sole purpose of human reproduction, and if same sex couples are entirely incapable of human reproduction, then it follows that god did not intend marriage for same sex couples b. This statement violates the 2nd test which is the relevance test. The reasoning behind the claim that god did not intend marriage for same sex couples is that because same sex couples do not reproduce or make children. The reasoning is not sound because some heterosexual couples who get married may choose not to have any children, some may encounter fertility issues and thus are unable to reproduce . . Janet says: “Daria is not a person of color, so | see no reason why we should listen to her on the issue of minority race relations. Jose is Hispanic; he’s the one we should listen to.” As a critical thinker, can you describe, in your own words, the flaw in Janet’s claim? Once you have completed your description in your own words, state which of the test of worthiness and reasonableness Janet’s argument fails and which fallacy she commits. a. The flaw in Janet’s claim is that it was based on a cluster of data based on predetermined conclusion. She did not even care to listen or hear the opinion of both sides. Janet was quick to draw a conclusion by basing it on how Daria looked as opposed to her knowledge on the topic. Daria may be the person who is able to answer the questions since she read the article. Although Jose is Hispanic, he may not actually know facts and information about the issue. b. In the test of worthiness and reasonableness, Janet’s claim is worthy and reasonable since Jose being Hispanic, he may be more likely to now about the issues in minority races more than Daria who is not a person of color. c. Janet’s argument falls into the category of “The Texas Sharpshooter Fallacy”. The Texas sharp shooters fallacy tends to cherry pick data clusters based on predetermine conclusion. Instead of understanding and letting the full spectrum of evidence lead them to their conclusion, they base it of assumption.
