1. List what you learned/know about each of the characters in the case. Explain in 3 –
4 sentences for each.
a) Katy- I learned that Katy was a child with special needs that according to her IEP needed an aide and additional resources to achieve in school. I learned that Katy came from a very loving and caring family that will do anything to advocate for her. I learned that Katy is sweet and is trying hard to keep up with everything going on around her. b) Christine

I also feel Janet has a lot to do with Christine feeling overwhelmed though because she keeps assigning a new aide in Christine’s classroom which may cause distraction for the other students in the classroom. c) the Alvarezes (Katy’s parents)

I learned that Katy’s parents are dissatisfies with Katy's placement. I also learned that they are very informed regarding Katy's needs and rights. —I learned that Ms. Butler is Katy’s aide who is always willing to be a helping hand. I learned that Ms. Butler helped to assist other classrooms and playground activities, therefore she was having to leave Katy. Because Ms. Butler helps out in multiple areas during school it leaves her to miss out on ample learning opportunities with Katy, which also leaves Christine to handle her class and Katy by herself. I learned that Ms. Butler was hired specifically for Katy and with her being out of the room a lot it is not as beneficial for Katy.
e) Janet

I learned that Janet was trying to keep the school running smoothly and by doing so she would constantly pull Katy’s aide to help out around the school. I think Janet didn’t fully understand the impact this was having on both Katy and Christine. I learned that Janet was just doing what she could to meet the needs of all students and while doing so it left Katy lacking the resources she needed to thrive. I learned that Janet didn’t fully understand the IEP and why the aide should be solely focused on Katy. 2. What do you think is motivating the thoughts/actions of each of the characters? Explain in 3 –

a) Christine

I think Christine is motivated by her desire to teach her best for her class. Christine is trying to ensure all her students are learning as well as Katy. I think Christine is an experienced teacher and is confident in her teaching ability, which motivates her to keep pushing and trying to make the situation work.

—I think what is motivating Katy’s parent’s thoughts and actions is the fact that it is their young daughter who can’t advocate for herself. Her parents are doing ever

can to advocate for her so that she gets the education she deserves. Katy’s parents want the best for their daughter and are very aware of what needs to be done to do so. I think overall they are motivated by the love and care they have for their daughter; they are only trying to get her everything she needs. c) Janet
—I think what is motivating Janet’s thoughts and actions is the lack of knowledge and maybe finances. It seems Janet has not dealt with parents like Katy’s, and she is overwhelmed by getting Katy an aide and the computer. I think overall Janet is motivated by making sure the school is running smoothly, she is not fully focused and Katy’s needs and doesn’t really understand what reassigning Katy’s aide is doing to Katy’s education. 3. What do you believe is the main issue in this case? I think the main issue in this case is the lack of knowledge of Katy’s IEP as well as the resources stated in the IEP. Stemming of this issue I also think a big issue is that Janet keeps reassigning Katy’s aide which is making it difficult for Christine. The school and teacher aren’t aware of every regulation that’s stated in the IEP therefore they are not making the accommodations necessary for her which is causing conflict with Katy’s parents. Katy’s parents seem to be very knowledgeable about what they know Katy needs and they are determined to meet those needs. I think as the school becomes more aware of the situation and everything Katy needs and they know they lack the finances to get Katy the resources she needs. The school is not used to dealing with parents who know the IEP of their child so well and they are struggling to cooperate with them and fulfill their requests.
4. What justification might Janet have for her actions concerning Katy’s aide assignments?
Janet’s actions concerning Katy’s aid assignments might be because of the lack of knowledge about the resources that need to be provided for Katy’s learning. Janet could also say that because it is a regular education classroom that students in the classroom should not need a personal aide. This could also lead to Janet saying that financially the school can’t afford to have a personal aide in their budget. Janet could use finances as a lot of the justifications such as Katy’s computer or other necessary technology resources she needs. 5. What reasons might the school have for opposing the request to have Katy placed in a regular education class? The school may be opposed to the request of having Katy placed in a regular education class because they feel she cannot keep up with the work and the school may not have the resources for all her accommodations. The school could also feel Katy may be a distraction to the other students because she does require an aide. Another reason could be that they are not used to having children's parents have knowledge of an IEP and all the regulations behind it, it may cause the school to be less confident in fulfilling all of the parent's requests. Lastly, the school may think Katy will not succeed in a regular classroom because she won’t have the attention or instruction she may need.
6. What are Christine’s ethical responsibilities regarding Katy’s accommodations in her class?
Christine’s ethical responsibility regarding Katy’s accommodations in her class is to provide Katy with the best possible resources. Christine is responsible for accommodating as necessary to meet Katy’s needs in the classroom. Christine should be focused and determined to meet all accommodation’s required in Katy’s IEP because teachers' primary responsibility is the students. Therefore, ethically Christine should do what is necessary to get an aide in the classroom for Katy as well as any assistive technology that will help her succeed.
7. What is the school’s legal responsibility regarding obtaining assistive devices or accommodations
listed in a student’s IEP?
The school is legally responsible for following the regulations and accommodation stated in any student’s IEP. They are required to provide any assisted devices for students who have it listed in their IEP. Assisted technology services must be available to any student that has special instruction if it is determined by the IEP team that the child will benefit from it. Lack of money or resources is not an excuse the school can use when not providing resources required for the student to be successful.
8. Why do you think that the Alvarezes succeeded in getting the aide and the computer listed in Katy’s
IEP? I think the Alvarazes succeeded in getting an aide and the computer listed because of how determined they were to get the best education and resources for their daughter. The parents were very determined and weren’t going to stop until they felt Katy’s had
everything she needed in the classroom, I believe their advocating for Katy went a long way in the situation. The parents are also very aware of the situation and know the IEP regulation stated in the contract very well therefore they know how to go about making sure the regulations/accommodations are met. I think the IEP does a lot for their case and the parents have it to fall back on every time because the schools are legally supposed to meet all needs and accommodations that are stated in the IEP.
9. What do you think that Christine should do? Why? Christine should inform Katy’s parents of everything that is happening so that they understand the importance of having an aide in the classroom for their daughter Katy. Christine should also speak with Janet and express the need for an aide in the classroom as well. Christine should explain to Janet that Katy’s parents have a right to know that Katy isn’t receiving her accommodations and that they do not have a plan to meet them. Christine may also hold a meeting with the parents and Janet to ensure they are all aware of the situation. Christine doing this will help get everyone on the same page which will get Katy the help that Christine knows she needs.
