Assessment Task Two: Case Study Answer 1 Ethical Factor After reading the given case, it noted that James Drever had been breached legally and ethically. In this case, Mr Drever breached the beneficence standard of nursing ethics, an ethical factor. The most imperative “ethical” principle in nursing care is beneficence. The fundamental ethic of “beneficence” is an essential feature of practised activity. The individual health consultant must respect his or her termed to high ethics of proficiency as an ethical obligation. It supports high values and purposes for the superior good afterward they have grabbed this ethic of care (Varkey, 2021) . Holding the hands of a “dying” patient is an instance of a nurse signifying this ethical principle. In this case, Mr Drever received the money in various forms over the three years while working as a nurse at the facility and providing nursing services to aged patients. He got money in numerous forms throughout his working career and received a transfer of a vehicle acquired by the patient into his name. He also offered to drive Hazel Jones to ‘non-Health Service’ appointments, such as lunch outings, shopping, and banking trips. Because he wrongfully received nearly $100,000 from a patient, it constituted an ethical violation. Since becoming overly involved in an inappropriate manner in accepting and receiving money from an aged care resident, he crossed the lines that should and typically exist between a registered nurse and a patient or care recipient. He also violated nursing principles and requirements. It states that nurses actively protect people’s dignity by demonstrating compassion and respect for persons in their care’s vulnerability and impotence (Abedi & Raee, 2017) . Mr Drever violated the nursing dignity because he did not treat her but harassed her financially. He demanded for money

from that also affect her mental health. Due to this, Ms Jones faced lot of challenges that also affect her treatment. Legal Factor In this case, a legal factor that had also been breached is the duty of care. A break of “duty” occurs when one individual or a corporation has a “duty of care” to somebody else, or an association yet mistreatments to satiate that standard. A patient might be at risk for inattentiveness in her or his injury case, assuming that their break of duty affected somebody else’s wounds or chronic mental sickness (Dowie, 2017) . The particular duty due to the patient has been penetrated, implying that the duty has not been met. As far as the protected climate, maybe a nurse neglects to put the bed “rail up”, and the patient falls. The nurse’s inability to keep up with the patient’s protected climate would comprise a duty break (Iwan, 2020) . In the given case, Mr Drever did not provide the required healthcare services to the patient. It is a legal issue because Mr Drever had the duty to use due care. He should have taken the patient’s concerns seriously and assessed her. He just met his patient outside and has taken money from her. As an aged care resident, Ms Jones had specific rights and securities under Federal and state regulations that assisted with guaranteeing she got the care and administration she wanted. It is likewise noticed that Mr Drever’s way of behaving was an illustration of “elder abuse”, which is characterized as “a solitary, or repeated act, or lack of proper act, happening in any association where there is a statement for trust. It hurts or misery to a more established individual. It noticed that elder abuse can be monetary, physical, mental or sexual and has “serious consequences for people”. This case additionally outlines the requirement for carefulness with respect to businesses, administrators and associates in aged care settings to
