REASONABLE SUSPICION TO STOP
Below are the reasonable suspicions why the vehicle was stopped:
- Weaving
- Weaving across lane lines
- Drifting
- Straddling a lane line
- Swerving
- Unnecessary acceleration
- Varying speed
- No signal
- Improper/unsafe lane change
- Appearing to be impaired
- Failed to stop at a stop sign when making a right hand turn
After stopping the vehicle, the driver was identified as Ashley Soloff using her Virginia License. While speaking to her, it was observed that a light odor of alcoholic beverage was coming from her.
It was observed that Ashley Soloff had:
- Bloodshot eyes
- Slurred speech
When asked, Ashley Soloff admitted to drinking two glasses of wine. Before beginning the test, Ashley Soloff was asked if she had any medical problems and she replied that she did not.
The following questions were asked to Ashley Soloff. PRE-FST INTERVIEW
Are you sick? No.
Are you injured? No.
Are you diabetic? No.
Are you epileptic? No.
Do you take insulin? No.
Do you have physical impairments? No.
Do you feel the effects of the drinks? Yes.
Have you taken any medicine or drugs? No.
Do you feel the effects of the medicine/drugs? No.
Do you wear glasses? No.
Do you wear corrective contact lenses? Yes.
Are you blind in either eye? No.
Did you bump your head? No.
Have you been drinking since the accident? No
HORIZONTAL GAZE NYSTAGMUS TEST
Prior to attempting this test, Ashley Soloff indicated she did not have any medical problems that would have prevented
her from performing the test. It was determined that she was wearing contacts. Her eyes were checked and they displayed unequal tracking and her pupils were unequal sizes. Ashley Soloff was instructed to follow the stimulus with her eyes only, keeping her head still. After stating that she understood the instructions, Ashley Soloff attempted this test.
The results of this test displayed 6 of the 6 possible clues.
- A lack of smooth pursuit in the left eye
- A lack of smooth pursuit in the right eye
- A distinct and sustained nystagmus in the left eye at maximum deviation
- A distinct and sustained nystagmus in the right eye at maximum deviation
- An onset of nystagmus in the left eye prior to 45 degrees.
- An onset of nystagmus in the right eye prior to 45 degrees.
The test revealed the presence of vertical nystagmus.
WALK AND TURN TEST
Prior to attempting this test, Ashley Soloff indicated she did not have any medical problems that would have prevented
her from performing the test. Ashley Soloff was instructed to put her left foot on the line and her right foot in front of it with her right heel touching the toe of her left foot. She was instructed to stand in this manner with her hands to her sides until the test instructions were completed and the test demonstrated. Ashley Soloff was instructed not to begin the test until told to start. She was instructed to take nine steps along the line in a heel-to-toe manner. After the ninth step she was to stop and turn around keeping her lead foot on the ground, taking several small steps with the other foot to turn around. After turning around she was to take nine steps in a heel-to-toe manner back along the line, in the direction she had come from. Ashley Soloff was further instructed to watch her feet at all times while walking, keep her
arms down to her side, and to count her steps out loud. After the test was demonstrated Ashley Soloff stated that she understood the instructions and was instructed to begin the test.
The results of this test displayed 6 of the 8 possible clues:
She was unable to maintain her balance in the instructed position. During the test, she stopped once while walking.
On the first set of steps, she took the correct number of steps. She didn’t miss any of the heel-to-toe steps. She stepped off the line on step 6.
She turned improperly.
On the second set of steps, she took the correct number of steps. She did not touch heel-to-toe on step 4. She stepped off the line on step 5.
She used her arms 4 times for balance.
ONE LEG STAND TEST
Prior to attempting this test, Ashley Soloff indicated she did not have any medical problems that would have prevented
her from performing the test. Ashley Soloff was instructed to stand with her feet together and arms at her sides during the test. Ashley Soloff was asked not to begin the test until instructed. She was instructed to raise the leg of her choice by approximately 6 inches off the ground. While holding that position, she was to keep her leg straight and count out loud starting at one thousand one (one thousand one, one thousand two, one thousand three, …) and so forth until instructed to stop (after 30 seconds). The test was demonstrated to Ashley Soloff.
After she indicated understanding the instructions, Ashley Soloff attempted the test and raised her right leg and was wearing sneakers.
The result of this test displayed 3 of the 4 possible clues:
- Swayed during the test
- Used arms for balance
- Put foot down twice during the test
LACK OF CONVERGENCE TEST
Prior to attempting this test, Ashley Soloff indicated that she did not have any medical problem that would prevent her from performing the test. It was determined that she was wearing contacts.

The test was performed at 19:17.
Ashley Soloff was first informed that a stimulus would be moved around in a circle and will be moved toward the bridge of her nose. In addition, she was also informed that the stimulus would not touch her nose.
Ashley Soloff was then instructed to keep her head steady and follow the stimulus with her eyes only. After stating that
she understood the instructions, the test started. The stimulus was placed 12 to 15 inches from the bridge of her nose
and then 2 inches away without touching the nose.
The results of this test showed that the lack of convergence was not present.
PRELIMINARY BREATH TEST
After completing the field sobriety tests, Ashley Soloff was asked if she would be willing to provide a sample of her breath using the preliminary breath test (PBT) device. She agreed to submit to the preliminary breath test.
Prior to conducting the test, the procedure was explained to Ashley Soloff, including the requirement to observe a 15-
minute waiting period to ensure the accuracy of the test results. During this time, Ashley Soloff was continuously observed to ensure that she did not ingest any substances, including but not limited to food, beverages, or tobacco products, burp, regurgitate, or engage in any activity that could introduce mouth alcohol or affect the test results.
The 15-minute waiting period was meticulously observed, and Ashley Soloff did not engage in any actions that would compromise the integrity of the breath test. After fifteen minutes Ashley Soloff's mouth was looked into and confirmed that it was empty.
Ashley Soloff was offered the preliminary breath test, which she accepted. She was told it was voluntary, it cannot be used against her unless to argue probable cause and she can access the results at any point. At 21:00, she blew into the PBT and the results indicated that her blood alcohol concentration (BAC) was at 0.12%.
Ashley Soloff was placed under arrest, searched and placed in the cruiser. Cased Closed.
