Final Project
Lately, the quantity of diversity of limited English speakers in the United States has multiplied. The high number of patients with limited English patients has made increased pressure and has required new legal requirements on the healthcare system and providers to ensure equal treatment like professional interpreters. Unfortunately, this brings a lot of miscommunications due to the language barrier, and fully understand what's going on from a family point of view. In the federal area the 1964 Civil Rights Act Title VI states:
“No person in the United States shall, on the ground of race, color, or national origin, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any program or
activity receiving federal financial assistance” 42 U.S.C. §2000d.
The healthcare system and providers must consider the patient’s religion, culture, beliefs,
and even ethnic background. Most of the time will influence how the patients or families
understand health concepts, how to take care of a patient, and how to make decisions concerning
someone's health. In this case, we see that the family is very religious, which happens with many
Hispanic families. The majority have a sense of if “it is happening it must happen, and God had a
plan, so it must be”. Correspondingly, we must consider that it looks like Maria is not the only
child most Hispanic families have 4 and more kids, and the oldest one is the one responsible for
the little ones. It’s an ethnic background and customs, the parent's main role is to work and
provide financially. Similarly, we must consider education level, and financial resources, and in
this situation, we know the language proficiency. In the phone conversation, we can understand
that the mom is in denial of how severe and sick Maria is, as per the oldest daughter. That is
always an obstacle for the patient due to the family not fully comprehending the severity of the
outcome.

Final Project
My facility does have an ethnic committee which also helps to ensure patients
particularly children, are well taken care of during the hospital stay and after. Case Management
involves and safeguards all possibilities for home care by the parents and helps from qualified
staff agencies.
The term “ward of the state” In overall means
“a child who, as determined by the State
where the child resides, is a foster child, is a ward of the State or is in the custody of a public
child welfare agency
” 20 USC § 1401(36)(A)
. In this situation, we must recognize that Maria
needs a lot of attention when a patient is placed on a tracheostomy most of the time the patient
needs to be on ventilator support it does need constant suction, monitoring, and making sure that
the airway on the patient needs to be patent clean and change when necessary. I believe that the
parents couldn't handle that their daughter was or it's going to be sick and fragile for the rest of
her life. Not being able to learn how to provide for the care of their child like Maria needs in
these multiple areas, unfortunately, lead to this decision from the hospital committee or maybe
them as parents, is unclear who. My humble opinion is very contradicted as a mother of three it
is very hard not to have and that able to provide for my kids and I will see myself taking care of
them until the end of time. Nonetheless, as a healthcare provider especially since I have worked
with kids for over 14 years, I want the best for them and I have been part of cases like this
situation, some have turned out beautiful and some we do have to take precautions and actions
and put them in foster care and special residences like facilities and homes that helped them and
there are qualified to continue their treatments. Therefore, I do believe that the correct decision
was made.
