Formative Assessment CHCPRT001 Activity Eleven Question One You are employed by the government department in your state/ territory that handles family and community matters. You have been asked to review the departments code of conduct and ethics. Conduct independent research and prepare a statement to insert into the departments code of conduct that defines what conflict of interest means. (1 page). It is considered unethical to work with children and young people when you have a conflict of interest. A conflict of interest may occur when you know the parents on a personal level. Having a conflict of interest may influence you on the decisions you make. For example, you might not think that the child or young person is getting abuse because you don’t think that the parents are like that or could do that. As employee we have the responsibility to: decline cash, gifts, rewards, or travel from suppliers or an individual. Employees need to be aware that accepting gift or benefits from a family member or friends from your work has the potential to create an actual or perceived conflict of interest. You need to consider how others may perceive the potential for influence on decision-making, especially regarding the purchase or procurement of goods and services. Employees need to treat everyone equally and fairly and do not show preference to any one individual or organisation. It is the policy of CFSS WA LTD , as well as a responsibility of the board, that ethical, legal, financial or other conflicts of interest be avoided and that any such conflicts (where they do arise) do not conflict with the obligations to CFSS WA LTD . CFSS WA LTD will manage conflicts of interest by requiring board members to: avoid conflicts of interest where possible identify and disclose any conflicts of interest carefully manage any conflicts of interest, and follow this policy and respond to any breaches. 5.1. Responsibility of the board The board is responsible for: establishing a system for identifying, disclosing and managing conflicts of interest across the charity monitoring compliance with this policy, and reviewing this policy on an annual basis to ensure that the policy is operating effectively. The charity must ensure that its board members are aware of the ACNC governance standards, particularly Governance Standard 5, and that they disclose any actual or perceived material conflicts of interests as required by Governance Standard 5.
5.2. Identification and disclosure of conflicts of interest Once an actual, potential or perceived conflict of interest is identified, it must be entered into CFSS WA LTD ’s register of interests, as well as being raised with the board. Where every other board member shares a conflict, the board should refer to ACNC Governance Standard 5 to ensure that proper disclosure occurs. The register of interests must be maintained by Managing Director . The register must record information related to a conflict of interest (including the nature and extent of the conflict of interest and any steps taken to address it).
