The class representatives approved this settlement since they received $500 per piece for participation as promised making them approve the settlement and could profit from the agreement. 2. The plaintiff’s counsel argued that the settlement did prove meaningful benefits to the class because Subway has bound itself to a case of procedures designed to achieve better bread-length uniformity. Is that a convincing argument? Why or why not? No. It is not a convincing argument. The settlement rules have been granted to benefit the class action lawyers but they do not even help the class. 3. Could there be any remedies that the court would find meaningful? Yes. If a remedy is beneficial to the class in anyway, the court would find it meaningful. If the Footlong sub was only 9, how would that impact the case? The court would rule in favor of Frank since it would mean that the class did not receive meaningful relief following the settlement. Is there a baseline as to how much a merchant can deceive a consumer? No. There is no baseline on how much a merchant can deceive a consumer. The court considers if the customer was deceived after determining whether they were misled in a material way.
