Functions and Processes Related to Sanctuary Cities Law Enforcement Courts What They Do Handles enforcement of law, maintains good order of society and apprehending criminals The court system handles crimes through due process. Jurisdictional Issues The stance on how due process is carried out is not agreed upon by all. The general public believes that the court systems are biased and do not carry out punishment fairly, therefore implying their rights are being infringed upon. Describe how the U.S. law enforcement and court systems function together . Multiple departments of local and state police come together to form the criminal justice system.The court syestem works together closely with law enforcement in criminal cases in ways such as determining the outcomes of hearings, sharing evidence, and determining alternative sentencing options. Include at least one dysfunction or challenge area. One dysfunction I noticed would be when an individual is apprehended by police more often than not the evidence gathered is not sufficient enough to hold charges on. This prevents the courts from being able to prosecute or hold the individual and are forced to free the defendant due to lack of evidence. Follow-Up Questions Answer the questions below in two to five sentences in order to elaborate on the process represented in the graphic organizer above. Use examples from the article provided in the Module Four Assignment Guidelines and Rubric to support your responses. 1. Identify the functions of law enforcement related to sanctuary cities in the resources provided. What is law enforcement allowed to do, according to Senate Bill 4? What impact or lack thereof has the law had on police operations? Once an arrest occurs, the court system must reinforce all departments associated. It is important to make sure proper organization and filing of paperwork is accomplished.
2. Identify the functions of court systems related to sanctuary cities in the resources provided. What did this US Court of Appeals for the Fifth Circuit do? What Constitutional issues may arise? Due to sanctuary cities, courts are limited on policies and procedures due to illegal immigration. For example, San Francisco is a sanctuary city. This being they can only hold immigrants who have violent records or once a warrant has been signed by a judge. Because of this, sometimes law enforcement will have to let people go because they can’t ask about their immigration status. 3. Describe how the U.S. law enforcement and court systems relate to sanctuary cities using information from the resources provided. How did they respond to shared issues? What is at least one challenge area for the police in relationship to holding detainees? The court system works to protect not only the citizens but the officers as well. If the law would’ve passed it would have violated one’s first amendment right. Since other cities have misunderstood and misused Senate Bill 4, Texas wanted to set an example for other states and show them the right way to handle the situation. One challenge I believe police have when holding detainees is the fact that they can’t ask about their immigration status. Being able to identify that early on in a situation might tell the officer the appropriate next steps to take.
