EQUAL EMPLOYMENT OPPORTUNITY SCENARIOS EXERCISE Your team name: BUFFALO 1) CAKES-R-US . Janna is an African American female. She applied for a job at Cakes R Us, a large manufacturer of premium baked goods. The company has a history of prior discrimination against minorities. She was refused employment because of her low scores on an aptitude test. Janna found out that very few African Americans have ever passed this aptitude test at Cakes R Us. - Do you think a violation of an EEO law has occurred? Yes - If yes, what law was violated? Civil Rights Act/Discrimination Adverse Impact - Explain (why or why not): Yes, because the aptitude test sounds like it is specifically discriminating against African Americans. There could be something wrong with the test that targets African Americans. Also, there should not be much knowledge needed for a baking company. 2) BUSSES-R-US. Busses R Us, a large charter bus company, requires a drug test of every driver before every chartered trip. Accident rates have decreased significantly since the company began drug testing. However, applying the test has resulted in disciplinary action and firing of a disproportionately large number of African American males. - Do you think a violation of an EEO law has occurred? No - If yes, what law was violated? - Explain (why or why not): No violation has occurred because drug tests are given to every Bus Driver. Driving a bus while on drugs would be bad. 3) COACH CLASS. Juanita is an executive with Bugs R Us, the national exterminator company. When she travels, she flies coach. However, when male executives from Bugs R Us fly, they fly business class. - Do you think a violation of an EEO law has occurred? Yes - If yes, what law was violated: Disparate Treatment - Explain (why or why not): A violation has occurred because both the male and the female employees have the same position yet the female employee flies coach.
4) ANIMALS-R-US. Animals R Us, a national retail pet supplies chain, uses employment tests which screens out a disproportionate number of Asian American women. Few Asian American women have ever been hired by the chain. The company explained that while Asian American women scored well on knowledge of pets, they scored low on empathy with pet-owning customers. - Do you think a violation of an EEO law has occurred? Yes - If yes, what law was violated? Adverse Impact (Discrimination) - Explain (why or why not): Asian women are being discriminated against because of a low scoring empathy test but this can be looked at as a cultural discrimination. Everyone shows empathy differently and a test such as the one in this example can be discriminatory. 5) DELI. A large deli is famous for its kosher food. The managers claim that Jewish employees are better informed about the food and how the food was prepared and make better workers. A person with experience at Boston Market and Sutton Gourmet applies for the job and is denied employment because she is not Jewish. - Do you think a violation of an EEO law has occurred? Yes - If yes, what law was violated? Title VII Civil Rights Act of 1964 - Explain (why or why not): A violation did occur because the manager discriminated against the candidate because she was not Jewish. 6) ROMEO. Mr. Romeo Casanova is the 45-year-old Chief Managing Partner of 1-800-Carpets, LLP, a company that sells rugs. Ms. Maria Pura Inocencia was just hired as a telephone operator at 1-800- Carpets. Maria is 19 years old and very pretty. Romeo brings flowers to her cubicle at work and asks her out on a date. - Do you think a violation of an EEO law has occurred? No - If yes, what law was violated? - Explain (why or why not): No, a law was not violated because nothing has occurred, but Romeo bringing Maria flowers and asking her out on a date.
7) BELLA AND BRUTUS. Bella is an attractive woman who tries to be nice to everyone she works with at the Los Angeles County Bureau of Bureaucracy (LAC-BOB). Her co-worker, Brutus, stops by Bella’s cubicle several times every day to chat, tell her jokes, and flirt. Bella finds that Brutus’ regular interruptions interfere with her work. She would really prefer that Brutus just left her alone, but her mother taught her to be polite to everyone. - Do you think a violation of an EEO law has occurred? No - If yes, what law was violated? - Explain (why or why not): No law was violated because she did not verbally say “No”, although the summary states that Brutus’ constant visits to Bella’s cubicle are disruptive to her work, Bella needs to speak up in order for something to occur. 8) CITADEL. Don is a recruiter for a large steel-manufacturing firm. His favorite and best recruiting trip is to his alma mater , The Citadel. The Citadel is a (mostly) male military academy. Don finds at least 80% of his annual new hires at The Citadel. He knows the faculty, the quality of the work and how to interact with the students. Most of those he has hired have demonstrated very good performance. Don’s firm is an active EEO employer. - Do you think a violation of an EEO law has occurred? No - If yes, what law was violated? - Explain (why or why not): No law was violated because where Don recruits from is The Citadel and it is not his fault that it is a mostly male military academy.
