Dominique Mckinzy HRM 310 11/21/2023 FMLA Grievance: I will be reviewing the complaints I’ve received about FMLA retaliation. Union employee- For union employees who submit a complaint about FMLA grievance, we will handle the matter as it should be. The first steps we at HR will take are to collect any information relevant to the complaints such as the initial incident and support details. I shall then contact a union representative on behalf of the union employee to make sure his/hers right are protected and being upheld. Our investigation will be conducted to a line with labor laws and the employees collective bargaining agreement to ensure unbiased treatment. Union Consequences- If complaints such as these are not taken seriously then there could be serious repercussions such as grievances filed by the unions, damage to the company’s reputation for not taking the complaint with the respect that it deserves. The company can also be at risk for legal consequences such as lawsuits for going against their protected rights and unfair treatment. Non-union employee- For non-union employees the proceedings are similar for taking on complaints. I will collect all relevant information on said complaint from the employee who filed the complaint such as evidence and the initial incident. I will then start the investigation and investigate following labor law and
company guidelines to ensure their rights are being protected. Non-union consequences- Failure to address employee complaints can also tarnish the company’s reputation and cause liability issues. This can also result in legal proceedings due to the violation of employment laws and the rights employees have. Employment law- Enforcing that all employees, whether they be unionized or not, should have their rights protected.
