M02-Rosemary Furman
1.
Who was Rosemary Furman, and what did she do to bring these cases about?
Rosemary Furman is the sole owner of d/b/a Northside Secretarial Services. However hen
looking into the company it is found out that Furman has never registered the Northside
Secretarial Service under the fictious name law. She has perfomed legal service for atleast 7
customers by gaining information from them and preparing pleadings in violation of Florida
law. She also sold do it yourself divorce kits and held herself to the public as “having legal
expertise in Florida family law.” She has never received any legal training or education, nor
has she ever had a license to practice being a legal attorney in the State of Floride or
anywhere. She is not, nor has she ever been, a member of the Florida bar. Furman charged
people a fee to the file and secure divorces as well as how to do so then tells the person to
take the papers for filing to the office clerk of Circuit Court. She never followed the
guidelines that were set for her to follow infact even after being told to stop she didn’t and
argued that it was impossible to run her business in compliance with the first courts ruling.
2.
Why was she tried twice?
Furman as tried twice because the first ruling stated that she needed to not engage with
any advising of client when selling her legal forms or printing out information. She must not
answer any questions or tell the client how to fill out any legal information or even where
they could fill it out on. While she was allowed to type up the information and sell and
advertise the information, she was not allowed to act as a personal legal assistant. However
instead of abiding by the directions that were clear to the court, Furman continued with

giving legal advise and answering and helping with any legal document forms for her clients
which ended with the Florda Bar to charge her for the second time.
3.
What was the ultimate outcome of her case?
The ultimate outcome of her case was that while she was not sent to prison for 8 months,
instead, she was sentenced to Duval County jail for a single term of 120 and the courts
suspended 90 days of the 120 day term of imprisonment. So she would be imprisoned for 30
days unless she violates the terms of their continuing injuction within two years, then she’d have
to continue her imprisonment of the 90days.
4.
Do you agree or disagree with the courts ultimate decision? Defend your answer with
specifics.
I agree with the courts ultimate decision. I agree because while what she had done was
technically wrong it wasn’t morally wrong. While she should have taken the precaution
measures given by the Florida state bar, IE, following the guidelines given by the state. I
also understand why she found it hard to do so because she wanted to help those who cant
read or don’t understand so I think that morally she wanted to do what was right. However
again, technically she should’ve followed guidelines, so I think the court giving her that
amount of time was a good idea.
