In the killing of Johnnie committed by Paul, it is appropriate to say that this act of crime constitutes as first-degree murder. In the given scenario, Paul had already made his mind up that he wanted to kill Johnnie, he knew where Johnnie would be and when he would be there. In order for a killing to be considered first degree murder, the killing must be carried out deliberately or planned out by the killer (Legal Information Institute, n.d.). Paul is aware that Johnnie hangs out at the gas station every Friday night. Paul decides to drive to the gas station at the time that he knows when Johnnie would be present there. With this thought process, it would be considered a planned event or premeditation for technical terms. This would disregard any defense that Paul could use to say he did not have any thoughts on planning this murder. Paul goes the extra lengths by placing the weapon in his compartment which is also evidence that he has planned this out. What would be the reasoning behind placing his gun in his car compartment just to visit a gas station? This would be clear evidence that Paul had intentions on killing Paul and had prepared to do just that. Paul ride by Johnnie while at the gas station and shoots Johnnie with the gun that he intentionally placed in his car on that Friday night that he knew Johnnie would be there. It is clear that Paul clearly premeditated killing Johnnie just by being aware of Johnnie’s activities and regular schedule. He decided to drive to the location where he knew Johnnie would be with a gun and then knowingly with malice, (Criminal Justice, 2015). He pointed the gun at Johnnie, aiming it at him, and pulling the trigger to kill Johnnie. If you go through the entire scenario, it is evident that all evidence and events add up to being considered a first-degree murder. Paul proceeded with voluntarily committing a crime
with the weapon, and the death of Johnnie was not caused by any failure to act on Paul’s own part.
