WRITING ASSIGNMENT #

Cyberbullying has, in recent years, gained widespread attention due to the deleterious
effects it has on the mental health of victims. Cyberbullying involves intentional and repeated
acts of bullying that create a power imbalance over information and communication
technologies[ CITATION Wil141 \l 1033 ]. Amanda Todd's story is a primal example of
cyberbullying, with the topmost ethical issue being privacy. The case study shows that
Amanda's privacy was violated by the perpetrator who obtained her personal information,
including her friends/ family data, address and school name [ CITATION Wil141 \l 1033 ].
Furthermore, the man threatened to leak her nude photo to the public if she did not heed his
demands. When she refused, the man created a Facebook page of her with the nude picture,
which led to ridicule and her untimely suicide.
The legal issue around the case is whether the bully should be held responsible for
Amanda's death. Legally speaking, the bully is culpable and responsible for her suicide
because he constantly harassed her[ CITATION Aud14 \l 1033 ]. Furthermore, the damage
wrought by the harasser is cumulative, with the basic homicide doctrine highlighting that the
bully caused harm. His actions contain all the characteristics needed to attain the condition of
culpability.
Therefore, his offences are result-oriented, with the end outcome being unlawful death
through the voluntary act of leaking Amanda's nude photos. The voluntary act is accompanied
by the mens rea, which is a criminal intent to disparage, taunt and harm Amanda's image
[ CITATION Wil141 \l 1033
\m Aud14]. The case against the bully is quite clear since his
conduct served as the actual and legal cause of Amanda's suicide. There are no indications
that her death would have occurred if the man did not bully her; thus, his actions prompted
her suicidal ideation thoughts. Moreover, Amanda's case can be termed as wrongful death and
corruption of a minor. This is because the bully was negligent and did not take into account

the impact of his actions on Amanda. Furthermore, he corrupted Amanda’s status as a minor
as he encouraged and enticed her to send a nude picture.
Based on Amanda's case, I vividly remember one of my classmates who was
subjected to cyberbullying. She was a stalwart student who, however, came from a poor
family. She was oft forced to repeat her clothes and, at times, came to school without
showering for days. Even though the teachers were concerned, they did not make any move
to help her with the situation. The lack of concern created a conducive environment for the
rest of the students to taunt her about her appearance.
Some students proceeded to create a Whatsapp group whereby they sent pictures of
her every day while discussing how dirty she was. One of her friends was part of the group,
and he showed her the memes and discussions. She disappeared from school for about two
weeks, with stories surfacing that she had committed suicide. By God's grace, however, she
came back to school after one of the board members decided to facilitate her education and
living conditions.
As an avid social media user, I strive to engage ethically with others. I respect the
privacy of other users while avoiding writing any messages or posts that might negatively
influence my followers. Furthermore, I report any posts or pictures that might contribute to
cyberbullying to create a conducive environment for everybody.
I think that school policies should introduce a strict no-bullying policy. This policy
will identify any perpetrators of cyberbullying and expel them from the school[ CITATION
Wil141 \l 1033 ]. Furthermore, the cyber bullies will be reported to the necessary authorities
to hold them accountable for any wrongful death or suicide caused by their actions.
