The exportation and sales of night vision fall under the ITAR when dealing with controls.
Night vision is placed under category three of title 22 of section 121, which is described as ammunition and ordnance. You must first figure out what the ECCN of your product is. You can do this on your own by analyzing the commerce control chart, or you may request an ECCN through the government if need be. Since the controls of night vision are deemed to be significant military equipment, as said in section 120.7 of the ITAR, this means that they are heavily regulated defense articles when looking into exportation. When you go about selling this night vision equipment you will need to fill out a license agreement with the government highlighting all the intentions of what you are going to do with your products and why you are exporting or selling it. Depending on where you are selling these goods, you might not need prior
consent to do so, but if you do and decide to ship them anyway then there will be repercussions highlighted in 22 CFR section 127 that outlines the violations and penalties. Additionally, in section 120 of the ITAR, there will be a definition of what a re-export is. This is an essential piece of the ITAR because if one of your customers were to order your product then proceed to send it to another country that may not be cleared for night vision equipment, the penalties will come back to you. If the equipment is coming back to you then you must investigate the DSP 15 CFR section 123.1 that will show temporary or permanent export license requirements.
