What regulation applies?
The regulations that apply are the Occupational Health and Safety Act, Section 23(1) (a)(b) and
(c).
Also Section 25 (1) (a) through (e) and Section 25 (2) (a) through (n).

2) Is an inspection a legislated requirement?
If yes, who conducts the inspection?
Yes, an inspection is a legislated requirement.
A health and Safety Inspector from the Ministry of
Labour would conduct the investigation since it included a critical injury.
This would be a reactive
inspection.

Is training needed in order to do the inspection?
There is no training needed in order to do the inspection, however, all new inspectors complete

How often should the inspection be completed?
The inspection should be completed annually at least, preferably more often for preventative
measures.
However, in this situation it would have triggered a reactive investigation so these
investigations can happen as often as necessary.
5) Does the inspection need to be documented?

6) According to what you have learned, to prevent this accident ...
The employee should have conducted a risk assessment prior to starting the work he was doing.
The
employee also should have ensured he was wearing all of the PPE that he should have been wearing.
If
he had been wearing work gloves the injury might not have been as severe. [ CITATION Gov23 \l 1033 ]
7) What should the employer have done?
The employer should have provided written instructions on how the work should be done.
The
employer should have ensured that the worker was properly trained in using the power tools that he
would be using.

8) What should the employee have done?
The employee should not have been playing around with dangerous equipment regardless if it was
unplugged or not.
Also, the employee should have ensured that he knew what he was doing and if he
did not he should have asked for help and guidance. The employee should have paid attention to his
work at hand and not have been in a rush to get finished.
The employee should have made sure he was
using all of the PPE that he was to be using at the time.
