TET1 TASK 2: PRIVACY 2 TET1 Task 2 Confidentiality of personal information has become a critical issue in the digital age. In this paper, I will discuss the ethical and legal reasons for keeping personal information confidential and examining how my school’s records are protected. Instructional Setting, Learners in your Instructional Setting, and Content Area I teach second grade at K-5 Elementary school in the suburbs. The content area is math more specifically being able to add and subtract numbers within 1000. Math instruction takes place in the morning from 9:30 to-10:30. The classroom has tables instead of desks. There are several different seating choices. There are swivel chairs, bean bag chairs, stools, and floor chairs. There is a kidney table used by the teacher to work with small groups. There are place value mats for each child and base ten blocks to be used as manipulatives. Classical music plays in the background during independent practice to help remove distractions. There is a projector and whiteboard used during instruction. The classroom has one desktop computer for the teacher to use and a class set of Chromebooks. Students work alone, with partners and in small groups. My class consists of 15 Caucasian students and 1 Asian student. Two students have IEP’s and are out of the classroom 90% of the time. One student is hearing impaired. I have three students diagnosed with ADHD. Most of the students in my class have a short attention span and lots of energy. I have three students reading and writing below grade level. The same three students also struggle with different math concepts. I have a lot of students who finish their class assignments early. One student was tested and accepted into the gifted program. However, he opted out so he could stay in my classroom 100% of the time. My students are highly motivated
TET1 TASK 2: PRIVACY 3 by positive praise. I looped with my first-grade class, so this is the second year I have had the same students. My students love school. Ethical Reasons for Maintaining Confidentiality Protecting students and their family from discrimination and protecting the safety of students are two ethical reasons for maintaining confidentiality. Teachers should respect students’ and families’ values, beliefs, sexual orientation, gender identification/expression and cultural background. With technology being a part of our everyday world, as a teacher I have all my student’s information just a click away. I am able to know if a student’s parents are going through a custody battle, if a student receives free or reduced lunch, a student’s previous grades, medical problems, and any discipline problems they may have had in the past. If I or another teacher was to talk about how a student was receiving free or reduced lunch and it was overheard by another student, it could be traumatizing for the student receiving the free or reduced lunch. As I child, I received free or reduced lunch and I would have been devastated if any of the other students would have ever found out. There is nothing wrong with receiving free or reduced lunch at school, but that information should be kept confidential to protect students from being discriminated against by peers. As a teacher, keeping my students safe is my number one priority. It is important to keep information such as the student's address confidential. If that information was released and got into the wrong hands it could endanger the safety of my student. If the family was going through a custody battle, or if there was an abusive situation the address of where they live could put my student and their family in grave danger.

TET1 TASK 2: PRIVACY 4 Legal Reasons for Maintaining Confidentiality There are legal reasons as well as ethical reasons to maintain a student’s confidentiality. FERPA, also known as The Family Educational Rights and Privacy Act and IDEA, also known as Individuals with Disabilities Education Acts are both acts that are put in place to protect a student’s privacy. It is essential to keep the information confidential unless legal requirements demand that confidential information be revealed or a breach is required to prevent serious and foreseeable harm to the student. Serious and foreseeable harm is different for each minor in schools and is determined by students’ developmental and chronological age, the setting, parental rights, and the nature of the harm. (ASCA, 2020) FERPA ensures that parents have access to public school education records, and to ensure a student’s right to privacy by protecting personal information from disclosure without explicit parental consent. (Darden, 2009) IDEA is to ensure that all children with disabilities have available to them a free appropriate public education that emphasizes special education and related services designed to meet their unique needs and prepare them for further education, employment, and independent living. The Individuals with Disabilities Education Act (IDEA) is a law that makes available a free appropriate public education to eligible children with disabilities throughout the nation and ensures special education and related services to those children. The IDEA governs how states and public agencies provide early intervention, special education, and related services to more than 6.5 million eligible infants, toddlers, children, and youth with disabilities. (US Department of Education, 2017) Interview I chose to interview the Educational Diagnostician at my elementary school because she handles students' and family’s information when it comes to anything with disabilities. An
TET1 TASK 2: PRIVACY 5 Educational Diagnostician identifies and recognizes the needs of exceptional learners and is responsible for developing IEP’s, setting meeting schedules with parents and staff, coordinate with special education staff. In my school district, all the student’s confidential information is stored in an online portal called Tyler SIS 360. This portal allows teachers access to all their student’s information such as IEPs, mailing addresses, report cards, family information, and attendance data all in one place. As a teacher, it is very convenient to be able to find all of this information in one place, but as a parent, it would raise concerns about how safe is all of my child’s information. I asked her how she reassures parents that their child’s information is kept safe and confidential. She told me Tyler SIS 360 is committed to providing online security and maintaining compliance with industry and regulatory standards. They have a third-party company that runs reports to make sure they demonstrate key compliance controls and objectives. I also asked how information such as IEP’s are kept confidential. She explained that even though all the information is stored in one place, not every teacher can access every student's information. Information such as IEP’s are only shared with teachers who will be working with that child. Therefore, if a child in my class has an IEP the other second grade teachers will not have that knowledge and cannot access that information. She explained the importance of teachers being properly trained and how crucial it is that all teachers follow the district policies and the law when it comes to confidential information. That is why FERPA and IDEA were put in place it is to protect our students.
