\Topic: Chapter 1 Case Study - The Department of Homeland Security 1. How does the creation of the Department of Homeland Security affect resources traditionally designated for local criminal justice organizations? 2. Are there too few resources to fight both terrorists and traditional criminals? \\\3. Who should pay the burden for investigating, apprehending, prosecuting, convicting, sentencing, and incarcerating terrorists? 4. Should Osama Bin Laden have been taken alive? 5. What are the due process protection questions in light of the creation of the Department of Homeland Security? 6. Should these due process protections matter in the fight against terrorism? Your thread is due by 11:59 p.m. (ET) on Wednesday and your replies are due by 11:59 p.m. (ET) on Sunday of Module/Week 2. Since 9/11, the government has done an excellent job in trying to protect this great country that we live in. One of its great additions was the creations of the Department of Homeland Security that was made “to protect the American people and their homeland.” (Stojkovic et al,2012). However, since the creation many has raise the question does the resources it take for the Department of Homeland Security takes from the local police agencies? I believe it take from the resources but add another dimension to local policing. They are now training local and state police to have a greater awareness of "suspicious activities" than ever, this will be better protect us in case of a terrorist attack. 9/11 Commission Report, state and local police agencies have found increased demands on their training facilities. Local police are asking for increased training in emergency response, special weapons, explosives detection, and crime lab techniques, which places a greater financial burden on state agencies responsible for providing the training (QuinStreet Inc, 2014). I think for the most part the federal government will fund law enforcement agencies, the money for terrorists and catching your traditional criminals because those two seen to be the heart of crime in the United States, that we pride ourselves on stopping. The government has to be able to protect the citizens from international criminals as well as domestic criminals. As I stated previously, I feel that the federal government has to be able to fund the resources for the American criminal justice system to do its part. It was reported that Congress funded 18 billons dollars to help combat against the Patriot Act that was enacted in 2001 (QuinStreet Inc, 2014). This shows if the federal government actually cares about the problems, Congress will create a grant that will help law enforcement agencies with the resources that they will need. After, the killing of Osama Bin Laden, many question the due process for terrorist that are capture by United States soldiers. In my opinion, President Obama called a perfect plan for the capture and his call of having him killed was just as great because a man that done, what Osama did to our country does not deserve due process under law. Also, bring him back and he have him await trial would have created too much turmoil so having him killed on the spot was a
better plan. I believe terrorist are not entitle to due process under the law because they are not a citizens in the country and most of the time they are trying to bring hurt to the country. Due process constitutional guarantee that all legal proceedings will be fair and that one will be given notice of the proceedings and an opportunity to be heard before the government acts to take away one's life, liberty, or property. These rights are guarantee to citizens of the country. However, the United Nations do have human rights that they expect everyone that’s a part of to follow. Many get these two rights confused because the due process for citizens of the United States whereas humans rights laws are regulation by the international government (United Nation) to make sure countries are not torture and holding people for unlawful imprisonment. When people thinking of violate of human rights, they need to think of the genocides that happens or China executing people more often for body parts. However, when it comes to terrorism, they should not be allowed due process under the law but we do need to make sure not to violate their human rights.
