Assessment instructions Assessment details Instructions Assessment overview The objective of this assessment is to assess your knowledge and performance on how to identify and work within the legal and ethical frameworks that apply to an individual job role. This applies to community services and health workers who play a proactive role in identifying and meeting their legal and ethical responsibilities. Instructions for this assessment This is a skills-based assessment in which you will be assessed on your ability to demonstrate the skills required for the unit CHCLEG001 Work legally and ethically. This assessment is in two (2) parts: Part 1: Four (4) case studies with questions following each case study. Part 2: Answer four (4) short answer questions. For parts of this assessment, you will need to access the Indigo Community Services and Health Hub . Part 1: Case studies For the purpose of this assessment, you are a community services worker at Indigo, which is a virtual community service organisation created for students to help them become familiar with the policies, procedures and guidelines of a community service organisation. Ethical Violation Procedure (Policy and Procedure) 2. Position Description – Community Services Worker (Administration) 3. Code of Conduct (Policy and Procedure) After you have read the three documents above, answer the following case study questions. Case study 1 One of your colleagues has recently lost her partner and is now a sole parent to three children. You have seen her taking food from the kitchen in the afternoon before she goes home. The kitchen is stocked with food intended for services users who are homeless, and staff are regularly told that the food is not for staff to eat. 1. Refer to the Indigo Code of Conduct and identify how the conduct of the employee in this case study breaches the Indigo Code of Conduct. In your response, you need to clearly state the section of the Indigo Code of Conduct that is being breached by the employee. The breach of the code of conduct by employee is in section 3.3 - Employee and management committee behaviour; Employees should not steal, damage or destroy property belonging to the organisation. 2. From the Indigo Document Centre , locate the Policy and Procedure folder and identify which policy or procedure the organisation can use to take action against this employee in relation to this breach of the Indigo Code of Conduct. The ethical violation of policy or law procedure ,policy, can be used to take action against the employee in relation to the breach. 3. Review the procedure you have identified in Question 2 and describe what you are required to do, as an employee who witnessed this breach of the Code of Conduct by your colleague. Your answers should include information about how you should document the information and who you should speak to about the breach of the Code of Conduct. As an employee who witnessed a violation of the code of conduct I would report it to my supervisor or manager, and would write a statement documenting factual, first hand information about the observed behaviours of concern (e.g. Stealing) and attach any evidence (if any) including the date and time. Case study 2 Alex, a regular service user, drops in to get some food. She has her eight-year-old son with her. You notice that she appears to be affected by drugs as she is very slow and appears to keep “drifting off” and napping while you are talking with her. You know that she has a history of using drugs, in particular opioids, which are strong pain medications. 1. Identify at least two Indigo policies and procedures that you need to consider in relation to this issue. Two policies and procedures to consider in this instance is the child protection reporting procedure, and the onsite alcohol and/or other drugs response policy. 2. Referring to the policies you have identified in Question 1 above, describe how you would initially approach Alex about her suspected drug use. Identify one (1) communication strategy you would use when approaching Alex. Before approaching I would scan the vicinity for emergency exits, duress alarms and any immediate risks in case of an escalation so I could ensure the safety of myself and others. Then using an even, calm tone of voice and speaking to Alex by name and try to establish what she has used. I would provide services/interventions to Alex. 3. Considering that Alex has an eight-year-old child with her, review the Indio Child Protection Policy and the Child Protection Reporting Procedure to determine what your reporting responsibilities are. Case study 3 Xavier, a nineteen-year-old with a moderate intellectual disability, attends a day program at Indigo Community Services and Health Hub. Xavier enjoys gardening and he is regularly joined by Michael and Bella. Xavier often ends up with a lot of soil on his clothing when weeding and planting new flowers. One afternoon, Xavier’s mother arrives earlier than usual whilst Xavier is still gardening. Xavier has been very enthusiastic with his digging on this day and has more soil residue than usual on his clothing, in his hair, and across his face from where he has wiped some sweat from his brow. Xavier’s mother sees this and is visibly upset. She walks over to Rosa (the support worker) and asks why her son is not encouraged to be more careful in looking after his clothing? Rosa explains that Xavier really enjoys gardening and is becoming quite skilled in recognising multiple types of plants. He is also now responsible for the upkeep of an area of the garden. Xavier’s mother explains that she does not want him getting so dirty ever again and does not want him to continue gardening if he is going to end up this dirty all the time. Rosa says that she is sorry and that she will remember this next time. Rosa does not mention this interaction with Xavier’s mother to any of her colleagues. The following day, Xavier comes to the centre and, during the morning, he collects everything he needs to tend to his garden. Rosa looks at him and says to Xavier “come and find something else to do today, Xavier. Your mum was really upset that you were dirty yesterday and doesn’t want it to happen again”. Xavier becomes upset and insists that he wants to look after his garden, particularly as Michael and Bella are already working in the garden. Rosa tells Xavier that it’s his choice and lets him continue gardening. When finished in the garden, Rosa continually encourages Xavier to wash his hands and face so that there is zero evidence that he has gardened. Xavier washes his hands more than 10 times in the space of 90 minutes. Rosa also asks permission to sponge Xavier’s shirt where there is a soil stain so that she can clean it off before his mum arrives. When Xavier’s mum arrives to pick him up, Rosa does not mention anything about Xavier’s work in the garden. 1. Identify and list the two (2) relevant Indigo policies and procedures that relate to this issue. 2. Complete the table below by identifying two (2) ethical issues associated with Xavier’s case study that have been breached, and detail how they were breached. (Use no more than 30 words per ethical issue.) Ethical Issue 1: Rosa ignored the mothers request to not let Xavier get dirty and instead made Xavier wash his hands excessively and hide that he’d been gardening How Ethical Issue 1 has been breached: Not being transparent and honest, breaching the code of conduct 3.2 Ethical Issue 2: Xaviar’s mother wont let him make empowered decisions for himself as an adult How Ethical Issue 2 has been breached: Rosa should have documented and reported the unethical behaviour and conversation from Xaviar’s mother to her supervisor breaching ethical violation procedure 3.2 3. There are many ways that Rosa could have managed this situation differently. Please explain how Rosa should have responded to Xavier’s mother, and also how she could have responded to Xavier. If Rosa was unsure what to do, who could she have spoken to? (150 words). Rosa could have acknowledged Xavier’s mum request; she should have then raised the issue immediately with her colleagues and supervisor if she was unsure what to do and to let them know of the interaction and the request from Xavier’s mother. Rosa also should have advocated for Xavier more and been honest, emphasizing he wanted to garden and indigo advocates for clients to be able to make empowered decisions and provides person centred care, then a plan could have been devised together with him and his mum going forward e.g. for him to have a spare pair of clothes or overalls specifically for gardening so his clothes don’t get dirty and he still be able to garden. Rosa also could have responded to Xavier differently, instead of saying “your mum was upset you were dirty and doesn’t want it to happen again”, which may discourage him from doing what he loves and make his hobby feel like an illicit activity or something he should feel guilty about doing. Case study 4 Kirsty is the mother of Lola who is nine years old. There is a current court order in place which prevents Lola’s grandparents from seeing her. Kirsty has enrolled Lola into an after-school kids’ program at Indigo Community Services and Health Hub, which Lola attends Monday to Thursday (4:00pm-5:30pm) whilst Kirsty is at work. Kirsty is concerned about Lola’s grandparents discovering where Lola attends the after- school program. She has not given permission for Lola’s photos to be shared anywhere so as not to alert anyone that Lola attends the program. Kirsty is aware that the program often celebrates special occasions with the children and has also requested that Lola not be allowed to join in the singing of ‘Happy Birthday’ to other children as this practise conflicts with the family’s religious beliefs. One day when picking Lola up, Kirsty was looking at the notice board at the entrance of the building and noticed that there were photos of the group. She saw a photo that included Lola with her best friend, Evie, in front of a birthday cake. In the photo, Lola appeared to be singing ‘Happy Birthday’ to Evie. Kirsty picks Lola up from the centre and later writes an angry email to the service’s team leader. 1. a) As the team leader at the service, what follow-up action do you need to take to address this situation? What can be done to ensure that this situation does not happen again in the future? b) In your response, include two communication methods you would use to share information with your colleagues at the centre about what happened and a strategy for the future so it does not happen again. Communication method #2: Another method of communication is written- An email sent out to all staff in regard to the complaint, detailing what the incident was and the conversation had with the mother. Outline and remind staff of the mother’s requests, the importance of respecting people’s cultures and religions and how explain how they were breached.
