2 IDEA and the IEP Process Ever wondered what an IEP was or what it can do for someone? An IEP is something that can help students who need extra help in an area as well as help the teacher deliver the best education properly. When creating an IEP there are many factors that are involved such as documentation, communication, observing, laws and regulations, and evaluating the student. Things to think about when creating an IEP would be IDEA and other regulations, collaboration, the IEP, and what you can learn from a facilitated IEP meeting. IDEA Something that you need to understand fully and make sure to follow when working with children who have or need and IEP is the 6 principles of IDEA. IDEA stands for Individuals with Disabilities Education Act and made a law in 2004 to protect students to ensure they receive the proper interventions while governing how states provide early intervention and special education (Parents Reaching Out, n.d.). When considering the 6 key principles of IDEA such as FAPE, appropriate evaluation and LRE you need to make sure to demonstrate the professional practice standards always. Some but not all the professional standards that need to be up held are using individual instruction to target all students at different levels, using appropriate and evidence based practices for students with exceptionalities, doing random assessments to track learning progress, create a safe place for students welcoming all races and cultural backgrounds, using appropriate assessments to make sure that no one is discriminated against, support the use of positive behaviors, avoid using aversive techniques, do not use or engage corporal punishment, report any and all unprofessionalism, and recommend special education services when necessary (Ethical Principles and Practice Standards, 2021). By following these standards, you can assure that you are acting with proper professional practice standards and are giving the students the best education possible while supporting their needs while following rules and regulation in
3 place to ensure proper, fair education for all students. For examples when tailoring your lessons to reach each student individually you are following LRE by making sure that each student is getting the proper education without leaving someone behind because of their special educational needs. Another example is by doing periodic assessments, creating a safe environment, and keeping communication with other teachers and parents you are following the FAPE and giving appropriate evaluation of the student (Parents Reaching Out, n.d.). While holding up professional practice standards and following the IDEA principles one major factor that needs to be completed is collaboration with others from an IEP team and the parents. Collaboration When considering all principles of IDEA and professional practice standards collaborating with an IEP team is critical. Making sure to be in collaboration with others who will help enforce the IEP or offer services to the student will give the best outcome in the IEP meeting and reaching goals to help the student. An IEP team should consist of a general education teacher who works in a general education environment, at least one special needs teacher who has the skills and knowledge to educate the student with disabilities, a representative of the school system who will possibly act as the facilitator, someone who can interpret the evaluation results and describe how this will affect instruction, others with knowledge about the child such as the parent or school system in the parent is unable, and the student when needed (The IEP Team | Center for Parent Information and Resources, 2022). It is optional to have more than one special education teacher and it is also optional to have the student with special needs present it is all depending on the situation. The CEC Ethical Principles and Professional Practice Standards will guide the IEP meeting by helping set guidelines of how things will be discussed, executed, and how they will be communicated to each other making for a positive welcoming meeting that is inviting for all members and helps reach the best plan for the student (Facilitated

4 IEP Meeting, 2023). Understanding the importance of who needs to be involved in an IEP meeting and how it will be run is an important part of fully understanding the IEP process. IEP While collaborating with other members of the IEP team, the educator needs to make sure to follow the process of an IEP closely to ensure that all steps are followed. The pre-assessment is the first step in the IEP process and that is when either the teacher begins collecting data on the student and their progress within the classroom, or if a parent brings to the school’s attention that their child has a disability to be evaluated. To ensure an appropriate evaluation is conducted IDEA requires that relevant information is collected from teachers, parents, classroom evaluations, as well as formal assessments (Parents Reaching Out, n.d.). While completing the IEP meeting everyone will discuss the evidence and the evaluation that was completed to further discuss the needs of the student and create an individualized education program (IEP) specific to the student. During this meeting all parties with collaborate and create a plan that will help the student succeed and will accommodate their needs. IDEA requires that all parents and students have a right to be involved in the decision making of the IEP and requires the school to provide written procedural safeguards to the parents at least once a year (Parents Reaching Out, n.d.). Following IDEA when compiling and IPE is very important to make sure that all laws and regulations are followed correctly to ensure the IPE is correct. If parties due not agree during the meeting they may have a mediator come in to try to resolve the issue before taking any further steps. At the point where there is still unable to reach an agreement the parents or the school have the right to appeal for a due process which is a more formal form of mediation ( BibliU - Reader , 2023). A due process is normally when the parents or school do not agree on the
5 student’s eligibility, the outcome, the IEP its self, or a part of FAPE which is guaranteed by IDEA (BibliU - Reader, 2023). Following all the correct steps and IDEA will ensure you have done your part as the educator to provide a fair, accurate IEP for the student being evaluated and discussed. The major components of an IEP are the students current academic ability and functional performance which is important to know when coming up with a plan for their IEP, a statement regarding functional and academic goals for the student to make sure they are manageable and to ensure everyone is working towards the same goal, a statement for students taking alternative assessments and their short-term goals, a statement about the services they will receive and modifications to the program to accommodate the student, a statement regarding and modifications to the state or district assessments to let all parties involved know the proper way for assessments, if alternative assessments are recommended for state or district assessments a statement why the student cannot perform them, a statement stating when services are given and how long they will last for to have a clear understanding of what the student will receive and for how long to be expecting to receive the services, a statement for all students over 16 for transitions, and lastly a statement regarding students annual goals, how they will be measured, and how parents will be informed (BibliU - Reader, 2023). There are specific legal structures to follow when completing and IEP such as the IDEA that gives you the proper procedures to follow to ensure a safe, accommodating IEP that meets all developmental, medical, and academic needs of the student. You should always use professional practice standards and make sure to follow all policies to make sure that everything is covered correctly and to protect the student ensure that FAPE is being followed. After knowing all the legal, policies, procedures,
6 how create and IEP, and the importance of IDEA and FAPE watching a facilitated IEP meeting could be helpful for an educator to takeaway key points to help them with future IEPs. FIEP: A Facilitated IEP Meeting After learning about legal, ethical, policies, and procedures some key takeaways that I will consider would be how to ethically and professionally approach an IEP and also how to collaborate and compile an IEP. As a new educator there is a lot to learn about the legalities and proper ways to create and IEP and making sure to follow IDEA is something that I would focus heavily on. Being organized and collecting evidence to begin an evaluation is a very important part of the process as well as recognizing and making changes to see if it will help the student prior to proceeding with an IPE meeting or evaluation. Conclusion There are many factors and policies that need to be in place when completing an IEP. Making sure that you are always implanting IDEA when conducting meeting, evaluating, and compiling evidence is critical to an organized, fair, and well laid out IEP. Collaboration amongst all members of the IEP team and the parents will ensure that nothing is missed and the best plan is put in place for the student. Having significant evidence to back up requesting an evaluation is the first step of an IEP but will play a big roll through the entire process as you will need it in every step to complete and Individualized Education Plan for a student. Following every step, policy, and law is needed to ensure a fair plan is in place that all parties are happy and comfortable with. I will make sure to focus on policies, laws, and making a comfortable, inviting environment for everyone involved in my IEP meeting while making sure to be very organized with as much data as possible to ensure everything is discussed in the meeting.
