La Evolución del Derecho en Puerto Rico
Introducción
Cuando nos referimos a el derecho en Puerto Rico y su evolución a través del tiempo sabemos que está lleno de cambios y adaptaciones. Desde tiempos de los indios tainos
hasta hoy día, el derecho ha existido de alguna manera tanto escrita como no escrita. Estas normas o reglas son parte esencial de cualquier sociedad organizada de hoy día.
Dichas normas provienen de modelos de derecho con raíces derivadas del derecho romano. El cual a través del tiempo fue adoptando diferentes características tales como
el derecho civil el cual se compone de diferentes obligaciones y derechos otorgados al ciudadano. El derecho común de Inglaterra, por ende, extendido a los Estados Unidos por el cual se rige actualmente. Cada uno de estos cambios y adaptaciones de derecho
han tenido un gran impacto en la estructura del derecho en Puerto Rico actualmente.
La Época Precolombina y la Colonización de Puerto Rico
Antes de que los españoles llegaran a colonizar a Puerto Rico, los indios taínos habitaban en la isla y tenían su propio sistema de derecho que carecía de complejidad. El cual se basaba, no en escritos, ya que carecían de un sistema estructurado de leyes y/o derecho, por tanto, las normas establecidas eran de tipo verbal, las cuales a su vez se convierten en costumbres y así pasan a ser implementadas generacionalmente. Con
la llegada de los españoles, se implementa el derecho castellano luego de la conquista.
El sistema de derecho castellano sustituyó el sistema taino previamente establecido, este cambio reguló muchos aspectos de la vida en la colonia mediante las Leyes de Indias, las cuales regían las normas para todos los habitantes de lo que en España se conocía como las Indias.
