5-2 Project Draft: Researching Your Topic 5-2 Project Draft: Researching Your Topic Danielle Eiland Southern New Hampshire University November 25, 2023 Know There is an incredibly contentious issue surrounding justice, and one can bet different individuals will not provide the same definition if one were to ask different people about it. From my perspective, the justice system was not designed to provide equal treatment to all individuals. Some individuals perceive the justice system as equitable, while others perceive it as unjust. Historically, it was a system designed to benefit only a particular group of people, as evidenced by historical records. While I am aware that justice is not always served in our country, there are numerous legal loopholes people exploit to avoid punishment and bypass the proper administration of justice. By taking advantage of these loopholes, those who victimize minorities are able to escape punishment, and I have repeatedly witnessed this. History: What are the inadequacies present in the justice system, and how do they contrast with the inadequacies we face today? Humanities: What can be done to make the justice system fairer for everyone involved? Learned A UCR (Uniform Crime Report) report for 2021 shows that 46% of arrests for non-fatal violent crimes were made by whites, 33% by blacks, and 21% by Hispanics. According to statistics, 60% of the population is White, 18% is Hispanic, and 13% is Black. As areas with higher poverty rates and racial inequality tend to have more intense police enforcement, the differences between population and crime may be affected by policing levels. With the rise of social media, it has become an effective tool for spreading positive messages and raising awareness about the justice system's shortcomings. This attention, however, can have dangerous consequences. As a result of the attention being paid to the Black Lives Matter (BLM) movement, violence against law enforcement and minorities has increased. In response, there have been riots, shootings, and other violent crimes. Increasing crime rates have resulted in fear-driven police officers targeting minorities as a result of increased media coverage and violence. In most states, a unanimous jury system ensures fair court rulings and penalties. Louisiana, however, used a different method in 1898 by allowing a decision to be made with just 9 jurors agreeing. As a result of the emancipation of slaves, white supremacy was maintained in the justice system. A jury system that was abolished in 2018 was declared invalid by the Supreme Court in 2020, highlighting the ongoing oppression faced by minorities and the wrongful imprisonment of innocent individuals.
5-2 Project Draft: Researching Your Topic The flaws in the American justice system require specific laws to address them, particularly regarding unreliable eyewitness identification procedures. Judicial oversight and providing defendants with case information can prevent wrongful convictions and biased testimonies. Failing to implement these measures escalates bias, marginalizing minorities and compromising their rights.
