Case Name: Miranda v. Arizona
Summary: Ernesto Miranda was arrested in 1963 as a suspect for kidnapping and rape. Miranda initially denied any and all involvement; but after the two-hour interrogation he signed a statement which confessed to the crime and that the confession was not coerced. After he was charged with rape and then sentenced to prison, Miranda appealed his conviction to the Supreme Court on the basis that he wasn’t aware of his fifth amendment rights to a lawyer and against self-incrimination. Majority of the supreme court sided with Miranda, which threw out his conviction on the basis that the police should’ve informed him of his fifth amendment rights. Impact of the case: The impact from this case had one of the largest impacts that has been seen. Miranda’s case had law enforcement practices and law is the requirement that all individuals be advised of their rights before they are interviewed by any law enforcement officer. This is known as a giving someone their Miranda warning. The practice caused an increase the ease of entering suspect confessions into evidence during a case, since the courts knew the defendants was aware of their fifth
amendment rights before they were initially interviewed. The practice of giving the suspects a Miranda warning can help increase the credibility of signed confessions since suspects can waiver their rights and choose to have a lawyer present. Case Name: Miller v. Alabama
Summary: Evan Miller was a 14-year-old who was sentenced to life without parole after he was convicted of murdering Cole Cannon. Miller appealed his case to the Supreme court on the basis that his eight amendments right protecting him against cruel and unusual punishment was violated. After the Supreme court heard his appeal, they stated that juvenile offenders are known to be less culpable
than adults; and that sentencing juveniles to life without parole does violate their rights.
Impact of the case: The impact from Miller v. Alabama was on how cases that involve juveniles and severe crimes are handled within the court system. Judges, defense attorneys and prosecutors needed to consider the underlying circumstances and the factors that led to a juvenile committing a crime before imposing the sentence. But based on the Supreme court’s decision with the Miller v. Alabama didn’t completely ban the sentencing of juveniles to life without parole, attorney is now under a new type of pressure for them to justify their reasoning for or against life without parole for these offenders.
