It is important in the manner that it is helping me as a counselor in training become more competent in PA state laws and in the ethical codes of the American Counseling Association. Being more competent knowledge wise
builds, the confidence needed to be a successful counselor. Learning the Pennsylvania state laws and the ACA code of ethics is helping me to assess my ability to uphold core professional values through evaluating my strengths and weaknesses to determine whether I have the ability to engage in effective counseling practices that not only benefit the client but help serve in my professional growth. Keeping up with the laws and regulations in counseling is so crucial in counselor development. -Are there any state laws or regulations that surprised you or that you were not aware of? Assisted Outpatient Treatment, or AOT, in Pennsylvania was updated in 2018, making the qualifications lesser than previous stipulations making people can qualify before they experience a mental health crisis in which they are deemed a danger to themselves or others. Not all of PA’s counties follow this law. AOT is a type of involuntary mental health treatment. A person with certain serious mental illnesses — such as schizophrenia or other psychotic disorders — can be court ordered into an outpatient treatment plan. That plan could include medications, therapy and/or psychiatric services, among other treatments and programs. There are two ways a person can get into an AOT program: upon release from a psychiatric hospital as “step-down” treatment; or, if the person is living in the community, then “any responsible party,” such as a family member, friend or mental health professional, can file an AOT petition with the court. The Pennsylvania 302 law is an involuntary treatment when an individua is seen as a danger to themselves or others A physician or police officer can authorize the medical evaluation without a warrant, or a petitioner — often a person’s loved one or a mental health professional — can sign a 302 form petitioning the county mental health administrator to issue a warrant. A 302-related evaluation
can last up to 120 hours, after which the person is either released or, if the doctor finds that the person needs extended treatment, a hearing can be held to extend the person’s involuntary treatment. If a 303 is initiated and the hearing orders an extension the individual will stay another 20 days. Then if extension is still needed a 304 is filed for 90 additional days. If another extension a 305 is filed for 180 more days.
