What constitutes the objection in short? Do you agree with Tully's response to the
objection? Why?
The second objection is that “legal, political and cultural pluralism will lead to the
disunity of the confederation.” (Tully) Tully completely objects this statement and states that it is
the complete opposite. I completely agree with Tully’s objection as culture should be seen as
something that enhances a person instead of threatening others by being different from theirs.
The world is becoming more advanced and diverse so it is important that our legal system
progresses alongside it. Indigenous Peoples have been victims for centuries due to policies meant
to assimilate them into White culture as the government believed that only having one culture
would be best. However, despite their best attempts, they did not succeed and there are still many
Indigenous Peoples that are proud of their culture and practice it. I believe that all cultures have
things to learn about others and if we used ideas and practices from each culture we would be
able to accommodate everyone’s needs while still being inclusive. Our legal framework should
respect and recognize many different legal traditions. If our legal system was more inclusive
towards Indigenous communities then I believe that the amount of injustice that happens towards
Indigenous Peoples would decrease significantly and we would see rates of violence, addiction,
homelessness, etc within that community decrease as well. If people are willing to work together
to make pluralism work, it would go smoothly. It would actually end up strengthening the
confederation as it would incorporate the perspectives and strengths from various different
cultures.
