Critical Legal Thinking Case 4.9 Exculpatory Clause Koch signed an agreement releasing Spaulding from liability for negligence. Therefore, the exculpatory clause holds valid. Koch signed the agreement on his own free will. Many questions come to mind. Did Koch fully understand what he was signing? Did Koch actually understand the dangers? Could Koch have sued to driver instead of suing Spaulding? On a moral and ethical standpoint, I do not feel like Spaulding was fair. Koch was seriously hurt and unable to work for quite some time. Spaulding should aid Koch with lost wages and medical expenses since the accident happened on Spaulding’s property. Many times, an organization will have a release of liability similar to the one Koch signed in an attempt to save money in case of an accident. These release of liability forms keep some people from suing, but should not stop Spaulding from doing what is morally right.
