Considerations: There are many different considerations that sports organizations should take before entering into a licensing agreement. One consideration that comes to mind is making sure they are doing what’s best for the team and their image. As the book says, “licensing is the act of granting to another party the right to use a protected logo, design or trademark.” Making sure the team, and the team’s name is protected is a big thing to consider. Throughout time sports organizations have found it desirable to initiate efforts to protect the investment in their name and marks through licensing. Protecting the team and the name is always the top priority. Another option to consider would be is it in the best interest of the team and their name. Knowing who the organization is getting into business with is key to making sure you are doing what’s best for the organization. Questions: The five questions I would ask the company to help me determine whether you should agree to a licensing deal are, 1. Is this deal going to benefit the team and the team’s name in the whole picture? Having an understand of if the deal will be what is in the best interest of the team and its logo would be my first question. 2. How will the license agreement make everyone involved money? Will everyone involved in the deal make money. This will prevent any problems down the road. 3. What platforms are being used to advertise the product? Knowing what is involved and how the logo/name is being used would be a top priority. 4. What are some of the sales goals for the company? Are they using the team and logo to make a substantial amount of money. 5. Who will be responsible for the liability of this product? This will prevent any future issues with lawsuits and whatnot.
