Express
“business Gold Rewards” credit card in 2012. Years later, American Express
sued the Arshad
Parties for breach of contract, alleging the Arshad Parties owed

filed a general denial. The trial court
ruled in favor of American Express, to which the
Arshad Parties appealed on two
issues: the factual sufficiency of the evidence used to support the judgment
on
American Express’s breach-of-contract claim and the claim the trial court erred
in
overruling the Arshad Parties’ objection to the testimony of Morales-Arias. The
Texas Supreme
Court found that the evidence produced by American Express was
sufficient based on the ArshadParties’ usage and agreement to the Cardmember
Agreement; thus, the Texas Supreme Court
overruled this issue. The Texas
Supreme Court also found that the trial court did not err in letting Morales-
Arias
testify because a corporation has a right to a corporate representative at trial,
even
if the corporation fails to disclose the representative as a witness in the
discovery phase; so, the
Texas Supreme Court also overruled this issue presented
by the Arshad Parties. Ultimately, the
Texas Supreme Court affirmed the trial
court’s judgment.
