Heaven Whitaker Professor Sullivan Assignment 1.3 12/15/23 Stalking Assignment 1. Identify the issues that existed with the original responses to stalking. Were these issues based on laws, law enforcement training, cultural views, or all of the above? Explain. Before laws began to change in the 90's revolving stalking there was little to nothing any law enforcement officer could do to help the vitcims unless their life was in direct danger. Lack of knowledge about stalking and how to react to the crime was a direct cause of the issue because cops were not trained on how to handle someone being stalked because at the time there was no laws against someone calling you a hundred times a day or watching you from a distance. The lack of laws to insure the safety of a victim of stalking tried law enforcements hands in every way. In reality there wasn't enough about stalking before the 1990's so many people didn't know how to react to it let alone how to handle it the correct way before someone got hurt. Since the increase of stalking in the 90's its have caused law enforcement agencies change their policies and giving more traning on how to effectivly handle a stalking case. 2. What do you think has changed since Peggy Klinke's death to cause the paradigm shift in the response to stalking? Will the changes in criminal law prevent outcomes like Peggy's from occurring? Why or why not? Peggy Klinke's death opened the eyes of not only the police but also the public to what a person could be facing with dealing with a stalker. Klinke did all the leg work for the police department in her area but that was still not enough to save her life. Law enforcement had no choice but to learn that they could no longer ingore the harmless threats or sit around with their hands tied. I don't necessary believe that if the police officers had the training that it would have changed Peggy's outcome because that man wasn't going allow her to live without him. The training would have helped in trying to protect her more and if he was arrested then maybe she would still be alive but in all honestly no one will ever know that answer. 3. Based on your review of the Criminal Stalking Laws for your State, how would Peggy's case be handled today in your state? Do you believe that your state needs to make improvements to the laws? What would you suggest? South Carolina code of law 16-3-1700 defines stalking as a patten of words or conduct of any form that has no true purpose, and is done in order to inflict on a person or would inflict on a reasonable person fear of death, assault, bodily injury, criminal sexual contact, and etc. In the State of South Carolina Patrick Kennedy would have been charged with a felony and fined a maxium of $5000 and could face up to 5 years in jail or both. My state should improve there laws against stalking because no one should have to be harmed or threatened with harm in order for our state to issue a restraining order because this just allows the stalker to get crafty with his or
her techinque in order to avoid jail time. 4. Public opinion has changed quite a bit in the last five to ten years in reference to stalking. One of the improvements has been training for members of law enforcement based on criminological research. Why do you believe it is so important for police officers and detectives to understand the "context" of an incident when a victim is reporting an incident, instead of just the information? I believe its important for an officer to understand the context of an incident because a stalker starts out doing little things from personal experience the phone calls that never end to the randomly being in the same area as you, or watching you through your social media pages. It the constant watching and waiting that a stalker does that any law enforcement person could learn from because they could pick up on that stalkers habits and rountie. Learning a stalkers behavior would give an officer the upper hand in helping catch them or find the ways that stalker is getting the information on the victim and help them use that to protect the victim better. 5. This assignment provided an example of how criminology has been utilized to better address problems, such as stalking. Provide an example of another crime that has faced a public paradigm shift and criminological research was used to support substantive criminal law changes for this crime. Another crime that has had a public paradigm shift would be Prosecuting Drug Overdose. Drug overdoes were once seen as and treated as accidental deaths but now because of the concept with lacing a drug these types of deaths have went under a microscope. Drug overdoses are now being treated and viewed as prosecutable homicides against the individuals who sold and distributed the drugs to the victim. WIth the dramatic jump in drug overdose cases between the early 1970's to now has struck an investigation into why and what are the causes behind it and thats because the increase of drugs on the streets and half the products are laced with something more dangerous. The criminal charges and criminal investigations have been increased as well. More training has been provided to the officers and first responders in order to try and save as many of these victims as possible thats why more of them now carry mutliple things of the drug named narco to aid in first aid to save a life.
