Hello everyone,
This week we are discussing the requirement of FERPA, CIPA, and COPPA in granting rights to an individual under the First Amendment. The scenario provided is to simulate system admin privileges for a
for-profit educational institution and discuss the requirements. Additionally, I will provide my input on why the laws outweigh special rights related to free speech. The requirements for FERPA, CIPA, and COPPA will be listed in bullet point format and below that will be the justification for the laws outweighing special rights related to free speech. Family Educational Rights and Privacy Act (FERPA):
Parents have the right to access student information until after age 18 and must obtain student consent
after that age.
Education information must remain private and disclosed only in certain circumstances, which also means obtaining consent from the student to release records.
Law applies to schools who receives funds under the U.S. Department of Education (Gilley, et al, 2006)
Different education institutions research the right to release education records without consent if it meets the following criteria: a transferring student, Jude or court orders, and compliance with authorities (Gilley, et al, 2006) Children's Protection Act (CIPA):
Prevents spread of children's personally identifiable information (PII)
Compliance allows for federal funding.
Preventative measures should be put in place to stop illicit activities from minors accessing the school's
internet (BN, 2023).
Restricts access to content deemed purposeless, irrelevant, or inappropriate to the student's education
(BN, 2023). Children's Online Privacy Protection Act (COPPA):
Regulates PII collection from those under 13 from websites (Masterman, 2019)
Privacy policy outlining steps to protect minors PII is the responsibility of website operators.
Applies to all websites collecting information from children (Masterman, 2019)
Regulated by Federal Trade Commission (FTC) In some instances, CIPA and COPPA have been abused, whether intentionally or unintentionally, by filtering out certain legitimate content that has opposing viewpoints than the school (BN, 2023). This resulted in lawsuits and has required school to go back and reconfigure their content filtering (Masterman, 2019).
